I was traveling out of town for work and unable to physically appear. This ticket was originally a proof of correction ticket; but now the court house is asking for $650. Quoting: chrion777 I was instructed to write a letter documenting my work absence and send proof of correction which I completed. The judge did not alter the fine amount and ruled the FTA was still enforced. I was told that I was not allowed to see a judge to provide proof of correction and address the failure to appear in person. Do I have any options at this point? I feel my civil and constitutional rights have been violated. While it is never fun to goto court or deal with traffic citations, I've gone through this in Los Angeles before, and there are always at least avenues to see the Judge in person. I feel that this is extortion because they get a lot of commuters in Banning that are not local and can not adequately represent themselves or defend their rights. Anyone have any options to recommend? You should have fought the original ticket in court. The pigs never show so the judge throws it out. |

If you did not object to anything, you probably don't have grounds for appeal unless you entered your proof in form of an affidavit. If the clerk states you have to pay the fine first, ask the clerk for a surety bond. It's better to know how to handle traffic tickets before you get one. Super simple to beat. Good luck! |
