EPA Grants Itself Power To Regulate Ponds, Ditches, Puddles
The EPA has released its Waters of the United States (WOTUS) rule critics say would allow the agency to regulate waterways previously not under federal jurisdiction, including puddles, ditches and isolated wetlands.

Republicans, farmers and industrial groups have called the rule an EPA “power grab” because it extends the agency’s powers to new heights. Environmentalists and the Obama administration, however, argue the WOTUS rule is necessary for protecting water quality.

No matter how you spin it, the EPA’s WOTUS rule does expand the agency’s authority, and creates new avenues for environmental groups to sue projects they want to stop from moving forward.

Interesting....

An interstate highway is going in near us and as this has been built for the last 2 years, I've seen all of these little signs beside the road saying "waters of the united states". It looked like they were just marking ditches.

Now I know what the signs are for... Just your friendly EPA grabbing control of everything in sight.

This is a HUGE DEAL!!

It has been in the works for some time ... and the Comments AGAINST it during the comment period came fast and furious from all corners.

Basically it gets the FEDERAL GOVERNMENT involved at every step of the way for EVERY DEVELOPMENT, including building (or draining) ANY farm pond, installing (or taking out) drainage ditches, building ANY larger building (including houses, barns, etc.) that are located outside of established city boundaries.

This IS a huge POWER GRAB by the Federal Government, but one should NOT be surprised by it since after all the REPUBLICANS ALREADY started us on the accelerated Federal Government POWER GRAB with their wonderful "PATRIOT ACT".

...and that's for people out in the country with "freedom"

True story. I built a house a couple miles out of town and moved in last year. A pretty affluent area in the midwest, where the suburbs end and the country begins.

bullshit I dealt with:

Almost 4 grand worth of permits for a 300k house. Plumbing, building, septic, city water hookup, mechanical, HVAC......unbelievable.

I acted as my own general contractor. They made it clear from day one they didn't like this.

There was an existing well, the old farm house was torn down and gone. I wanted to use it to water lawn etc. City water was run for my house. I couldn't keep the well. They said I had to fill it in. Ok then. I'll fill it. No, they said, it has to be capped by a certified well driller. If you fill it we'll have you arrested for "tampering with ground water". Exact words they used.

A whole list of other BS.

Then I move in. They assess me at 407k, which is 98k more than the bank and a realtor valued it at. I appeal, twice, and they lower it to 346k. Now i have to appeal to the state, in the meantime my property taxes are way more than they should be.

This article says that “The scope of jurisdiction in this rule is narrower than that under the existing regulation. Fewer waters will be defined as ‘waters of the United States’ under the rule than under the existing regulations, in part because the rule puts important qualifiers on some existing categories such as tributaries.”

To my understanding there will now be less protections for streams and rivers and a narrowing of jurisdiction.

It is illegal to collect rainwater or even snow-melt here in Colorado.
Ways around it though.

1. You can bury the barrels and camouflage the spout tube from the roof or wherever. Siphon pump for usage.

2. You can label the barrels "Fire Water" in big bright letters. They can't touch that. Only works if you live rural though.

Still places exist that are beautiful, land is fair for price, and people/government mind their own bees-wax business.
City-Data forums is a good tool.

Sacrifice the so called amenities for a sense of freedom.

When I lived in Chicago I got the impression that there's a lot of this sort of slavery. Now that I am in the NYC suburbs I don't get that feeling.

I'd wait a few days before uncapping that well but yes, of course I'd find a way to uncap it or run a pipe into your basement underground from under the cap. Fortunately they said cap it not fill it in.

Since I live on the east coast, they would have a hard time taxing my rainwater. I own rights to the air above my land via my title.

Out west, the titles typically do not include such air rights or mineral rights. You get much less rights with a title out west, I guess because the whole place is essentially a desert and the government wants ultimate ability to control the precious water.
