From my reading, actually intent is important, or at least if you can convince them that you have a permissible reason. If you have zoning that has disparate impact that it keeps the blacks away, but you have some other excuse for it, that can make your zoning stand up. You've got to have a non racist excuse. That's the recipe. |

If you have zoning that has disparate impact that it keeps the blacks away, but you have some other excuse for it, that can make your zoning stand up. You've got to have a non racist excuse. That's the recipe. The majority opinion held that "disparate impact" could be found if the alternatives wouldn't have caused more impact. The only way to avoid disparate impact, as this ruling reads, is to run a statistical analysis on racial segregation and choose the option that minimizes it. Residential quotas will by necessity become a reality in urban housing developments. They're entirely ignoring economics. The overhead cost - land, construction, etc. - can't exceed the amount of funds available. One theoretical location allows for the construction of 50 units; another allows for the construction of 10. The court held that disparate impact could be claimed as the 50 unit location would lead to greater minority population density. Considering Houston Housing Authority has a wait list exceeding the population of many mid-American counties, the court ruled that homelessness was preferable to the appearance of de facto segregation. Everyone is worth knowing. Everything is worth learning. You're never too good. You're never not good enough. |
