Senate panel OKs warrantless wiretaps

WASHINGTON -- A Republican-controlled Senate panel on Wednesday approved legislation that would authorize President Bush's controversial warrantless wiretapping program in return for his pledge to submit it for a review by a secret court.

In a 10-8 party-line vote, the Senate Judiciary Committee sent the bill backed by the White House to the full Senate.

With 2 1/2 weeks before Congress recesses for the Nov. 7 elections, the White House has made it a priority to win approval of a highly secretive National Security Agency program to intercept calls and e-mails between the U.S. and overseas in its hunt for terrorists.

Sen. Arlen Specter (R-Pa.), committee chairman and the bill's sponsor, said his legislation provided the best chance for the Supreme Court to rule on the president's authority to unilaterally order the program. But under the bill, an appeal to the court would be up to the discretion of the administration, the White House and legal experts said Wednesday.

Specter's bill would broadly revamp the existing law on domestic electronic surveillance--the Foreign Intelligence Surveillance Act, enacted in 1978 in response to government's abusive spying on citizens. FISA created a special secret court to issue warrants for domestic eavesdropping on foreign spies and terrorists.

Sen. Russell Feingold (D-Wis.) and other committee Democrats complained that the bill guts FISA, but Specter defended it by saying he was seeking to put the program under judicial review.

In return for broad changes in FISA, Specter said, Vice President Dick Cheney promised that the White House would submit the program to the FISA court.

The court would hear only arguments from administration lawyers. Only the administration could appeal and probably would do so only if it lost.

Specter's bill also moves 29 cases filed against telecommunications companies involved in the program to the FISA court, providing another possible channel to the high court, a Senate aide said. But those cases could reach the court without Specter's bill.

The committee also sent two other bills on the program for Senate debate, one by Sen. Mike DeWine (R-Ohio) that would narrow congressional oversight of the program, and another sponsored by Specter and Sen. Dianne Feinstein (D-Calif.) that would streamline the warrant process but retain FISA's exclusive oversight of domestic surveillance.

The worst thing about this and all the other information gathering gluttony is that no person (save a few wackos) is pristine. So, whomever is in charge will hereon have the power to squelch all opposition by hook AND by crook. Any potential political candidate. Any movement can and will be demonized and nipped in the bud. It is the means to royally and publicly tar and feather any opposition to anything the squatter in the white house feels is counter to his/her agenda - or even annoying.

The bush admin has already demonstrated that they relish punishing citizens who have done nothing wrong but DO PISS THEM OFF. Valerie Plame. The spate of the famous and politicos who've mysteriously wound up on the no-fly lists. And when they're really pissed they "Wellstone" their foes.

It has never been a problem for the govt to obtain a wiretap warrant from a judge at any hour day or night when needed! What this does is eliminate a paper trail and accountability. The ONLY reason for this is to do things that are against the law and leave no tracks.

I won't be surprised if this doesn't even make the evening news since the media, for the most part, has been bought and paid for long ago.

The reason I ask, one of the major issues opponents to gay marriage used is the so-called 'slippery slope' argument.

Leftists and gaymongers were quick to dismiss said issue as a logical fallacy... now YOU are using it in this context. You do not get to cherry pick which logical fallacy would best suit your argument or refute your opponents.

Sinanju, privacy of the People is implied in the constitution.

The lawful government is authorized by the constitution in only one situation to act directly upon the People. They can draft men into the military in cases of war.

They are also authorized to regulate commerce, so if you choose to be an owner or officer of a business involved in commerce, they have some authority over you in that capacity only. Otherwise, what you do is none of the federal government's business.

If they want to tax the Poeple according to the constitution, they must set an amount that each of the People shall pay and send a bill to each of the states apportioned according to their population.

They are authorized to impose excise taxes, and duties and imposts, but these tax activities, not the People directly, and are known as indirect taxes.

EVERYTHING ELSE THAT EACH OF THE PEOPLE DOES IS NONE OF THE FEDERAL GOVERNMENT'S BUSINESS. If the People commit crimes, that is the business of the local police and the states.

You can see why the federal government fascists hate the constitution and how far we have strayed from its guidelines.
