I did go to a dr. after the accident. They initially thought I had a fractured bone in my neck turns out not so. I was in pain for over three weeks. Took 10 ex rays. Seems fine now. As far as the car , it's hard to tell there has been any damage until you look under the back bumper. there is quite a bit of damage under the car because of the was I was hit. No prior pictures though. They are trying to say the seat was due to normal wear and tear, wrong. it sat up perfectly before but not now. Never had it to a mechanic there was no need outside of normal oil changes. |

Get copies of your medical bills. YOu can also get paid for pain and suffering. I got hit by a lady and had to see Dr once. Got paid $500.00 for Dr. visit and pain/suffering. Plus the damage done to the car. Also be advised you will lose in resale value due to their insured's neglegance. YOu need to get compensated for that as well. Insurance companies always try it on and there's usually a bit of ping pong that goes on, but if you collate the facts and figures you should be in line for a much bigger payout. For both your car and the injury/pain. It sounds like you had whiplash, which is pretty common when you're rear ended. 'Don't see an attorney taking this because there really is little damage to my health.' 3 weeks of pain was damage to your health that you wouldn't have suffered if you hadn't been hit. Over here we have lots of solicitors who specialise in these kind of claims. I'm sure you must have similar in the US. |

I will start compiling information and start planning a suit in small claims. I did talk to an attorney today after all. I sent him damage estimates and he is looking at all of this for me. About 1500 dollars damage to the car and seat that will not sit up right after being thrown into the head rest. Hurt my neck and spent 3 weeks in pain as a result. Get a letter from the insurance company today only willing to pay 190 dollars damage for repairs. They say it was prior damage to the car. The car has never been in a wreck before. So, just don't know what to do. Don't see an attorney taking this because there really is little damage to my health. Ideas and input is welcome. I had my kids in the car with me. My older daughter said her neck hurt, and I hurt my back, neck, and right hip. My daughter refused treatment, but I ended up in the ER. My car never got fixed, and my medical bills were not paid. I got a lawyer, but waited until the last minute to do so. I should have got one right at the beginning. We are going into mediation soon, and if it doesn't work out, we will be in court next year. Yeah, sometimes it takes years to be compensated, but you cannot give up. If you were rear ended, the guy who hit you is at fault. The guy who was at fault in my accident had an insurance company called American Access. They had the gall to call me 6 months later, and offer to pay 1/2 of the cost of a used bumper from a car a year older than mine, with me picking up the other half. Well, I told them where to go, as I wasn't at fault, their client was, and that was not the only damage to my car. When the jerk hit me, it pushed my bumper up, and into the body of the car, damaging the frame, the bumper, sliced the tail lights,the rubber strip between the bumper and the car body was destroyed, and caused a gas tank leak. The gas gauge never worked after I got hit, either. Essentially, my car was totaled, or close to it. Praise God from Whom all Blessings flow !!! |
