Coming Soon to SCOTUS: Cops No Longer Need a Warrant to Enter Homes and Seize Evidence
' The Wisconsin Supreme Court just dealt a death blow to the Fourth Amendment, which is supposed to protect a citizen against unreasonable search and seizure. What’s more, the decision was made by a single, newly-appointed judge who was not even present when arguments were made in court.

In a 4-3 decision, the state’s highest court ruled that evidence seized in a person’s private home during a warrantless search can be used against the person under an expanded view of the “community caretaker” clause. '

Looks like this will be heading to the SCOTUS docket.
The loss of Scalia at this point in history will be sorely felt. Especially with ball-less wonders like John Roberts.

We need to pay attention to key state decisions that will be coming up before SCOTUS soon.

I'm pretty confident Obama will nominate someone very soon, and the glorious "opposition" will simultaneously approve the nominee while whining and complaining that it's unfair.

Thanks. Interesting.

IF Obama's nominee gets in, then we really have tyranny. The only obstacle in the way of utter tyranny has been the Supreme Court. If the Court is lost, then we truly enter into a formal tyrannical form of government. All the pieces are in place in the other branches, and ready to go.

I've not seen anything like this in my 50 years.

I am worried.

I'm worried as well. The court has usually been fairly balanced (I think) but looking at the roster now, it's tottering precariously.

Well now, isn't that special.

I think if someone is trying to enter your home illegally without a warrant with the sole purpose of wanting to take your stuff, I think said person would be considered an home invader and a safety threat to you and your family, right?

Hell, that's only common sense.

' The decision Wednesday was also notable in that Justice Rebecca Bradley joined the majority that reversed the Court of Appeals, even though she had not heard arguments in the case, which occurred before her appointment Oct. 9 by Gov. Scott Walker. '

Another classic sell-out by a RINO who appointed a clueless imbecile. I think discovering why Walker appointed her would be worthwhile for any investigative journalist.

Is it even in doubt anymore that the GOP is just the flip side of the coin from the Democrats?

Edit: Sorry. I forgot the link to the above quote. If you look at it, you may understand why I think someone should investigate Walker's decision to appoint Bradley.

I think (like you) that the Court has been fairly balanced to this point. Yes, a few things that are worrisome have gotten through. There are also some worrisome things that have been blocked thanks to the balance. Now, we are in real trouble and I do not think the majority of Americans are aware of how dire the situation is. I am not one to exaggerate, nor get really worked up and panic. BUT.....THIS IS A BIG DEAL.

Seems that you are right about keeping an eye on what is before the Court. Now that our news stations ONLY COVER the Presidential election 24/7, with virtually NO OTHER news, there is much that can happen in the shadows.

Well the idiot let them into his home so he sort of lacks commons sense. But once inside, they busted down a locked door that he refused to open for them. They cited the " 'community caretaker' claus" as their right to violate the 4th amendment.

Is "community caretaker clause" even a fucking thing? So in order to void the Constitution, they just have to wave their "community caretaker clause" card.

' The "majority's embrace of a broad, ever-expanding version of the exception risks transforming a shield for evidence encountered incidental to community caretaking into an investigatory sword." '

Simply put, that "community caretaker function" is an open door for abuse by the police state.

Nice going Bradley.

When you add the volatile ingredient of military style tactics and equipment and trigger happy cops to the mix, the "no-knock search warrant" just becomes blatant home invasions.

If it ends up a 4-4 tie in the Supreme Court then the lower court ruling will stand.

That's true. We might be faced with a favorable tie if it had been Ginsberg who had passed away, but favorable ties are probably not going to happen much on the current 8 member court.

Exactly. I think he will because......there's no real opposition in Congress.

It will go from no-knock warrants (legal home invasions) to plain old home invasions. All for the sake of "community caretaker functions."

More likely now to be overturned with Justice Scalia replaced. Conservatives are the proponents of such police tactics not a more liberal court which tends to lean more toward Individual rights instead of blanket warrants. A left leaning court is more likely to restrict police

I used to agree with you on that. But we have the most "liberal" administration in history and it has advanced ( or at least aided and abetted) a police state agenda via the Department of Justice.
