Watch Out for the Textalyzer Quoting: gmigriff The most provocative idea, from lawmakers in New York, is to give police officers a new device that is the digital equivalent of the Breathalyzer — a roadside test called the Textalyzer. It would work like this: An officer arriving at the scene of a crash could ask for the phones of any drivers involved and use the Textalyzer to tap into the operating system to check for recent activity. The technology could determine whether a driver had used the phone to text, email or do anything else that is forbidden under New York’s hands-free driving laws, which prohibit drivers from holding phones to their ear. Failure to hand over a phone could lead to the suspension of a driver’s license, similar to the consequences for refusing a Breathalyzer. [link to www.nytimes.com] Okay this is fucked! There is a problem with texting while driving Opening up your personal info to LE strangers is NOT the solution! these mother fuckers use anything and everything to invade your liberty True solution would to coordinate software between the phone company with your vehicles onboard computer to either disable texting while driving or alert via some interop layer / system without being forced to invade your privacy. you setup software "specifically" to focus on and look for the defined issue. Too much power given to individuals who have proved time and again that power corrupts absolutely. Agreed. The article claims the device would only detect activity and not have access to personal data, which very well could be bullshit. I call bs also on the premise that every damn cop I see lately has a cell plastered to his ear or driving with their eyes on their damn computer screens in their cars. Idiots policing idiots for the same crimes. Typical bs. Good point - they're a bunch of thugs and hypocrites. If they were really interested in public safety, they would drug test every cop for illegal steroid use... at least a third would fail and need to be fired! |

The device is a scaled-back version of a more intensive phone-scraping technology created by the company, which promises that the device doesn't give access to personal conversations or apps. Instead, the textalyzer only determines if the phone was in use at the time of the accident, with the option for a more in-depth crawl should the police officer obtain a warrant to search the driver's phone. "I have often heard there is no such thing as a breathalyzer for distracted driving — so we created one," said DORC co-founder Ben Lieberman in a press statement. "Respecting drivers' personal privacy, however, is also important, and we are taking meticulous steps to not violate those rights." The bill includes language that gives law enforcement "implied consent" to having one's phone tested at the scene of the crash. Fourth Amendment rights are not violated, they claim, because no actual phone data is being mined by the technology, as reported by Ars Technica. But some civil liberties groups are skeptical that in practice, use of the textalyzer will be as un-invasive as DORC claims. "Distracted driving is a serious public safety concern. But this solution is not tailored to the problem," said Donna Lieberman (no relation to DORC's Ben Lieberman), executive director of the New York Civil Liberties Union (NYCLU). "The technology may in fact be scanning through the content of people’s phones and collecting data, even if that is not apparent. And even if you finely tune the technology, there are many cases where people will be fined for lawful activity. There are several ways someone could be using a phone in line with distracted driving laws that could run afoul of this test." "I think a law that essentially requires you to hand over your phone to a cop in a roadside situation without a warrant is a non-starter. I know that the supporters of this law talk about how it is designed to keep police away from these sensitive areas of your life. But really, that’s ridiculous. They’re human and they stray or make errors in judgment," he said. Quoting: Anonymous Coward 48279663 Fuck you if you text while driving. Your license should be gone for holding a phone to your ear while driving. You don't care about your safety or the others around you.. then I do not care about your rights. You do know, AC, that most likely that device will be used to justify stealing your phone, putting you in jail, and/or far, far worse, right? You're being rather single minded about this too. How do any of us know for a fact or multiple facts that this Textalyzer device will actually detect your phone sending and/or receiving texts WHILE you're driving. You could do like me and while driving get a text just press the X button real quick on the text box to make it go away so your phone's screen turns off again so you can easily focus on the road while driving. Chances are even this practice will be used against me and all others with this Textalyzer device. Somehow I suspect that this device will even detect you getting at text while your phone is off so if that is accurate you're completely and utterly fucked while having a cellphone on you while driving and/or while a passenger in the vehicle. This is very bad news for all of us drivers. Conspiracy Theorist is nothing more than a derogatory title used to dismiss a critical thinker. A time is coming when men will go mad, and when they see someone who is not mad, they will attack him, saying, 'You are mad; you are not like us." -- St. Anthony The Great Social Credit Loser here. |
