“It’s been a nightmare,” said homeowner Tamara Holloway. “The seller has essentially pirated my house.”

The seller is Justin McCrory. He says he’s lived in the property for four years and has every right to still be there.

“The transaction went through and they’re getting a good clean property,” McCrory told News 2. “What’s the problem?”

The problem is that Holloway closed on her home on June 1, and there isn’t an amendment saying he could stay past the closing date.

“I technically don’t have to go anywhere,” said McCrory. “They’d have to evict me and they’re not having that.”

But Holloway showed us a detainer warrant she filed Thursday, which is the first step in the eviction process.

When reporter Jessica Jaglois continued to ask questions, McCrory became hostile.

“Shut your mouth,” he said. “You need to learn to take orders!”






What a whackadoodle. I feel sorry for the lady who thought she was getting to move into her own home. What kind of person sells a house then tries to stay in it? Bizarre.

Wells Fargo does it all the time.

My brother purchased a house at auction from Wells Fargo. The last tenant was still there and it took three years, thanks to a retarded judge in Arkansas, before he could live there.

Wells Fargo lawyers lied to the judge multiple times and she caught them, but still, they didn't suffer at all because they contribute handsomely to her on a regular basis and that is all perfectly legal according to state law.

Bet they never loose.

Start remodeling. Begin by removing the doors. Then the windows. Might want to get the air conditioning unit "checked" on your new home, also.

In the Virgin Islands, they take off a roof section, which shuts off the rain water to the cistern.

There are some problems in life that should be dealt with by following the law and working within the system to seek justice... Then there are other problems that need to be dealt with by pushing a cash stuffed envelope across the table at your local biker bar. This problem falls into the latter category.

In a "normal" transaction, you walk through before the closing on the day of the sale and the place better be "broom clean". You get the keys at the closing, and then go to the house and change the locks.

In a foreclosure, you get a good deal on price but have to deal with whatever problems are there, including current residents, if any. You have recourse to the courts and cops, of course, and if you're enterprising, there's the biker bar scenario. It's a bit crazy to literally break into a house that is not obviously occupied, but has all the curtains closed. I've been there, armed with the closing papers and deed.

The guy in possession here is obviously a nut case.

I was trying to buy a house here in Houston a few years ago and the seller accepted the offer except he wanted to lease back the house for 30 days to give him time to move out. The agency on my side of the transaction was totally against it because apparently in Texas once a lease agreement is complete the person can remain in the house on a month to month basis until the new owner takes them to court. The sellers agent was his daughter which also gave my agent some concern. So we walked away from the deal and bought another house. A few months later my agent contacted me and said the guy sold hus house, leased it back and then refused to move out. Just as we feared. The guy stayed in his house until he died there over six months later. I really wanted that house but my agent was so adamantly against the leaseback that he talked me out of it and I am sure glad I listened to him.

It would cost a wee bit of money to new owner later (cheaper than court) but air conditioning/heating would quit working just for starters. She's got papers saying it's hers now, all utilities swapped over are on "vacation off". Same with mail, swap to PO Box and send all his back "addressee moved".

Crazy that could even happen.
