My brother purchased a house at auction from Wells Fargo. The last tenant was still there and it took three years, thanks to a retarded judge in Arkansas, before he could live there. Wells Fargo lawyers lied to the judge multiple times and she caught them, but still, they didn't suffer at all because they contribute handsomely to her on a regular basis and that is all perfectly legal according to state law. Bet they never loose. |

You get the keys at the closing, and then go to the house and change the locks. In a foreclosure, you get a good deal on price but have to deal with whatever problems are there, including current residents, if any. You have recourse to the courts and cops, of course, and if you're enterprising, there's the biker bar scenario. It's a bit crazy to literally break into a house that is not obviously occupied, but has all the curtains closed. I've been there, armed with the closing papers and deed. The guy in possession here is obviously a nut case. |

I was trying to buy a house here in Houston a few years ago and the seller accepted the offer except he wanted to lease back the house for 30 days to give him time to move out. The agency on my side of the transaction was totally against it because apparently in Texas once a lease agreement is complete the person can remain in the house on a month to month basis until the new owner takes them to court. The sellers agent was his daughter which also gave my agent some concern. So we walked away from the deal and bought another house. A few months later my agent contacted me and said the guy sold hus house, leased it back and then refused to move out. Just as we feared. The guy stayed in his house until he died there over six months later. I really wanted that house but my agent was so adamantly against the leaseback that he talked me out of it and I am sure glad I listened to him. Have a nice day = GFY. GFY = Go Fuck Yourself.
