The number of protesters is now over 4000 as many tribes have united to protect the land and water from contamination.

KFYRTV reports, “The Army Corps of Engineers has confirmed that the company doesn’t have a written easement from the agency to build on Corps property. A corps spokesperson says that Energy transfer has filed the paperwork for the easement but it’s still under review.”

“That’s true they don’t have the easement that’s required to install the segment that’s across the Oahe project,” said Larry Janis, Army Corps Of Engineers.

I have to comment on this. I have current first hand experience with an oil pipeline coming through our farm. In our case, the pipeline company took us and other landowners to court, claiming eminent domain, and won. They started taking people to court and started land clearing operations before they had all of the permits, including Corps of Engineer permits, acquired to even be able to lay the pipeline. This tells me that the pipeline companies know that the government agencies will rubber stamp their permit applications. The pipeline companies wouldn't spend millions of dollars on legal proceedings "easement acquisitions", and land clearing operations if they thought there was a chance of government agencies not approving the permits for the installation of the pipeline.

We own 655 acres of land in Arkansas, and a pipeline coming from Oklahoma and heading to Memphis, TN. is coming across our farm. We refused to allow them to place the pipeline on our land, so they took us to court for eminent domain, and won. State law basically guarantees them the ability to do this. We tried every avenue, contacted state and U.S. senators and representatives, governor and Lt. governor, attorney general, corps of engineers, state archaeologist and historic preservation group, etc. We did receive a lot of help and some extra protections to our property due to the presence of pre-historic and historic sites, but in the end, the pipeline is still coming through. Two weeks ago, they started clearing operations on or land, cutting and shredding trees, cutting fences, moving dirt.

My parents bought this place in 1962 when the area was backwoods wilderness. I inherited it from them and live in the same house I grew up in. My dad raises cattle and still makes his living from the land, and we make a portion of our income from the land. Looking forward to passing it on to my children, but now we will have this blight upon our land, and if the pipeline ever breaks and leaks, a portion of our land will be completely ruined.

Private, for profit corporations should not have access to the power of the state to claim eminent domain over landowners.

Yes, they of course do have to pay you for the easements, but in many cases what they have to pay does not come close to the total value of what they take. How can you put a price on the sentimental value of certain trees or rocks? How can you place value on the potential of a future pipeline break and oil spill, or how can you place value on having peace of mind or having increased stress levels due to witnessing destruction of your land? Those are the things that make it difficult to accept.

1882 Hopi Reservation Created

The BIA agent created a reservation centered around his offices, which were located near the Hopi villages on the mesas. The Dineh occupied the vast rangelands surrounding these mesas, so that 60% of the land within the reservation was occupied by Dineh. The land surrounding the 1882 reservation would later become part of the Navajo reservation. For the next 70 years, these arbitrary borders had little affect on the people, as both Hopi and Dineh continued their traditional way of life and peaceful relationship.
A link to an execellent history page. Although the author of this page passed on in the summer of 1997, her page still tells the history of this area better than others. Paula Giese's work is timeless.

1951 The Coal Rush Begins

The richest known deposit of coal in the U.S. was on the northern part of the 1882 reservation. The Hopi did not have a government that could sign leases, as the people practiced their traditional self-government; and their religion forbade coal mining. In 1951, John Boyden was appointed by the BIA as a land claims attorney for the Hopi and began organizing a government which would be able to issue coal leases. The coal rush had begun. In 1955 his government was recognized by the BIA as the sovereign government of the Hopi people. A similar process was underway on the Navajo reservation, where their appointed land claims attorney obtained a contract giving himself 10% of all future coal mining revenues.

1958 Healing Vs Jones

The land title was unclear as to who owned the rights to the coal deposits; Norman Littell's Navajo government, because the land had always been inhabited by Dineh, or John Boyden's Hopi government, because the land was within the 1882 reservation. The lawyers filed a friendly suit asking the courts to clarify the land title - Littell's government even offered to loan funds for Boyden's expenses. The resulting decision in 1963 said the governments could lease the land and split the revenues 50/50. The Hopi were given exclusive surface rights to the area they traditionally inhabited near the mesas. The Dineh land became a Joint-Use area shared by both tribes.

1967 Peabody Coal Lease

After the leasing authority was established, a lease was quickly agreed with Peabody Coal giving them the right to mine the area. The royalty rates to the tribes were far below standard commercial rates, as John Boyden, who negotiated the leases for the Hopi, also worked for Peabody Coal! (that is - he was on their payroll as an employee) The traditional Hopi leaders filed a lawsuit opposing the lease, as the Black Mesa area is Sacred to both the Hopi and Dineh religions, and strip mining violated their traditional religions. While the Hopi demonstrated that Boyden's government acted in violation of it's own BIA-approved constitution, the U.S. courts rejected the suit because Boyden's government was recognized as a Sovereign power and thus, was immune to lawsuit in U.S. courts.

1974 Relocation Act

Boyden requested Congress to partition the Joint-Use area into separate Dineh and Hopi areas, so that the Hopi could obtain better access to the land traditionally inhabited by the Dineh. The 1974 Navajo-Hopi Settlement Act was pushed through Congress by a group representing the coal-fired power industry, which believed their industry would benefit by having the U.S. government finance the eviction of all the people living in an area larger than the state of Rhode Island. In their rush to promote national energy self-sufficiency, Congress never considered where the people would go or how relocation would affect their lives. Nor did they consider the wishes of the people they planned to relocate. John McCain authored this "relocation" bill.

1980 A Site for Relocation Purchased

The U.S. government purchases a uranium-contaminated site near Chambers, AZ as the "New Lands" for the evicted Dineh. This site qualified as a candidate for the Superfund cleanup after the worst RADIOACTIVE SPILL the world has ever known!
Instead of spending money for a cleanup, they thought it could be purchased for a very few dollars, and used for the "New Lands" for the evicted People!

I am here in ND and in the midst of this. Did you know that Black Lives Matter is supporting these protest? Did you know that 90 percent of the protestors are from California and Oregon? You need to research facts before posting.

A Democracy Now! reporter that documented security personnel with guard dogs working for Dakota Access Pipeline is facing criminal trespassing charges in Morton County.

Authorities have issued an arrest warrant for Amy Goodman of New York for a class B misdemeanor, according to court documents.

Goodman can be seen on news footage from Sept. 3 documenting the clash between protesters and private security personnel with guard dogs at a Dakota Access construction site, including footage showing people with bite injuries and a dog with blood on its mouth.

The video footage has been widely cited by people who have since criticized the use of dogs by the security Sheriff's Office.

The Standing Rock area is now basically a NO FLY ZONE. Road access has now been cut off, water, phone and Internet service has been cut for over a month. Local, State and Federal Military forces on the ground right now. The militarized police then circled the protesters in an apparent move to ‘kettle’ them — a tactic usually reserved for urban protests in which riot police force large crowds into corners to seemingly provoke them. However, the protesters stayed entirely peaceful.
Police continued their mass arrests even though the people were trying to leave. Some natives were seen running for the hills as the assault began.
One officer is seen in military camouflage with a ski mask and a tear gas grenade launcher — as if he were going to war. In total, reports Hafiz, more than 140 people were detained in half an hour. It was the largest roundup of protesters since the movement against the pipelines intensified two months ago. A majority of those arrested were charged with rioting and criminal trespass. Overall, close to 300 people have been arrested since protests against the pipeline kicked off over the summer.
Among those arrested were journalists, a teen child who was also pregnant, and an elderly woman.
They were all brought to the jail where protesters were forced to sit in the jail’s common area as police had no other place to put them. According to Hafiz, women were strip searched, protesters were refused phone calls, and no one received food or water. One woman even had her medication confiscated by police, causing her to shake and sweat profusely.
When Hafiz was finally released, she attempted to get back her camera and was told that she could not have it back. “Your camera is being held as evidence in a crime,” they said.
In the land of the free, filming cops assault peaceful men, women, and children is considered a ‘crime.’

Seventeen financial institutions have loaned Dakota Access LLC $2.5 billion to construct the pipeline. Banks have also committed substantial resources to the Energy Transfer Family of companies so it can build out more oil and gas infrastructure:

Energy Transfer Partners has a revolving credit line of $3.75 billion toward expanding its oil and gas infrastructure holdings, with commitments from just 26 banks.
Sunoco Logistics has a credit line with $2.5 billion in commitments from just 24 banks.
Energy Transfer Equity has a credit line with another $1.5 billion in commitments from most of the same big international banks.
All told, that’s $10.25 billion in loans and credit facilities from 38 banks directly supporting the companies building the pipeline.

These banks expect to be paid back over the coming decades. By locking in widespread drilling and fracking in the false name of U.S. energy independence and security, the banks are increasing our disastrous dependence on fossil fuels.

I know enough indians to know that EVERYTHING they say is a lie.
They are professional victims that just want free shit.
Thats the problem here, the indians are liars.

They broke down a fence and attacked the corporations guards, and they ran into the dogs, but only one or two got bit, but they asked for it.

The oil company jumped through all the legal hoops, and they tried to pay the indians to croos their land, but the indians held out for more money.
So the company just took a longer route OFF INDIAN LAND.

So they started shit with some hockey fans.

Then they left and said the next day that the kids got beer dumped on them by the white hockey fans. it went to court and the kids admitted THAT WAS A LIE TOO.
