I think what really distinguished (early) Rome was that they refused to be ruled by Kings - Consuls and sometimes 'Dictators' were elected for a yr at a time from amongst the Patrician families.

They insisted on the rule of law and maintained a strong honour code, instead of utterly vanquishing their foes they tended to incorporate them into the Roman system - their army was formed of citizen soldiers.

The Byzantine ceased to have any meaningful Roman heritage, when the Roman nobles intermingled with the Greeks, and eventually switched to the Greek language, as their official language in 610 AD. Or rather, they where as Roman, as the "Holy Roman Empire", was Roman.
