BECAUSE THAT"S WHAT THEY FOUGHT FOR No one is saying they don't have the right to protest. They just don't have the right to protest while under contract with the NFL and their teams. They can do it on their own time, but if they do it while on the clock, they should be suspended. This is NOT speech protected by the 1st amendment. And I am a Veteren and retired LEO who has defended the 1st amendment, first hand, countless times in my career. This would not be one of them. When someone is on the clock, under contract, and collecting a paycheck, they don't have the right to say what they want. They are subject to employee conduct clauses. This is the case for military, law enforcement, the medical field, and most definitely professional sports. The NFL teams absolutely have the power to enforce their conduct clauses and it absolutely would NOT be a violation of players 1st amendment rights, but some are too cowardly to do it. I bet there will be teams, that don't have any players who do this, because they quietly told their players it will not be tolerated. In the absence of any discipline or even a statement by his direct employer, the 69's, the ones who sign his check, he is fully in first amendment teritory. |

The 1st ammendment protection only comes into effect when someone tries to stop said speech. If the Niners told him he had to stop, because of the contract he signed, he would not receive that protection. Just because the Niners have decided for whatever reason not to enforce his conduct clause doesn't mean he is within his 1st ammendment rights, he is just getting a pass on the contract. The main point is, if any of the NFL team told or have told players they can not protest, it would not be a violation of the players1st ammendment rights. The teams would be well within their rights to do so, that many haven't shows just how afraid they are of the PC, SJW and liberal MSM cabal. Sad really.
