A Proposed Constitutional Amendment
Background and justification to Amendment 28

Whereas Religion is defined as an institution dedicated to improving social conscience and promoting individual and societal spiritual growth in a way that is harmless to others not participating in or practicing the same;

Whereas the United States of America was founded on the ideals of individual rights, including the individual right to practice one’s religion of choice, or no religion, and that there would be no compulsion of religion, nor state sanctioned religion, nor a “religious test” for participation in the body politic;

Whereas Islam includes a complete political and social structure, encompassed by its religious law, Sharia, that supersedes any civil law and that Islam mandates that no secular or democratic institutions are to be superior to Islamic law;

Whereas Islam preaches that it and it alone is the true religion and that Islam will dominate the world and supplant all other religions and democratic institutions;

Whereas Saudi Arabia, the spiritual home of Islam does not permit the practice of any other religion on its soil and even “moderate” Muslims states such as Turkey and Malaysia actively suppress other religions;

Whereas Islam includes as its basic tenant the spread of the faith by any and all means necessary, including violent conquest of non-believers, and demands of its followers that they implement violent jihad (holy war) against those un-willing to convert or submit to Islam, including by deception and subversion of existing institutions;

Whereas on 9/11/2001 19 Muslim hijackers acting in the name of Islam killed 3,000 Americans, and numerous other acts of terrorism have been directed at the American people around the world;

Whereas representatives of Islam around the world including Osama Bin Laden (architect of 9/11), the government of Iran including Mahmoud Ahmadinejad, HAMAS, Hezbollah, and other Islamic groups have declared jihad (war) on America, and regularly declare that America should cease to exist;

Whereas there is no organized Islamic opposition to violent proponents of Islam;

Therefore: Islam is not a religion, but a political ideology more akin to Fascism and totally in opposition to the ideals of freedom as described in the United States Constitution, especially the Bill of Rights.

Be it resolved that the following Amendment to the Constitution be adopted:

Article I

The social/political/ideological system known around the world as Islam is not recognized in the United States as a religion.

The practice of Islam is therefore not protected under the 1st Amendment as to freedom of religion and speech.

Article II

As representatives of Islam around the world have declared war, and committed acts of war, against the United States and its democratic allies around the world, Islam is hereby declared an enemy of the United States and its practice within the United States is now prohibited.

Article III

Immediately upon passage of this Amendment all Mosques, schools and Muslim places of worship and religious training are to be closed, converted to other uses, or destroyed. Proceeds from sales of such properties may be distributed to congregations of said places but full disclosure of all proceeds shall be made to an appropriate agency as determined by Congress. No compensation is to be offered by Federal or State agencies for losses on such properties however Federal funding is to be available for the demolishing of said structures if other disposition cannot be made.

The preaching of Islam in Mosques, Schools, and other venues is prohibited. The subject of Islam may be taught in a post high school academic environment provided that instruction include discussion of Islam’s history of violence, conquest, and its ongoing war on democratic and other non-Islamic values.

The preaching or advocating of Islamic ideals of world domination, destruction of America and democratic institutions, jihad against Judaism, Christianity and other religions, and advocating the implementation of Sharia law shall in all cases be punishable by fines, imprisonment, deportation, and death as proscribed by Congress. Violent expressions of these and other Muslim goals, or the material support of those both in the United States and around the world who seek to advance these Islamic goals shall be punishable by death.

Muslims will be denied the opportunity to immigrate to the United States.

Article IV

Nothing in this amendment shall be construed as authorizing the discrimination against, of violence upon, nor repudiation of the individual rights of those Americans professing to be Muslim. The individual right of conscience is sacrosanct and the practice of Islam within the privacy of home and self is strictly protected to the extent that such individuals do not violate the prohibitions described in Article III.

A Constitutional amendment to say that we don't think that the Church of Islam is protected under the first amendment? Do you even know how the system works? What you're describing is more like a situation where the supreme court ends up ruling that the Church of Islam doesn't qualify for first amendment protections. It's happened before with other faiths and the Supreme Kangaroo Court, and could probably happen again with Islam. We're certainly supposed to hate Islam, aren't we... Ask yourself why?

Have you read the Quran?
Have you read the Torrah?
Have you read the Talmud?
How 'bout the whole Old Testament?
Did you notice all of the cruel stuff about the "Goyim" being less than animals and unworthy of anything? Is that from the Muslim faith? How about how the Catholic church had this little thing called the Inquisition, where it killed and tortured in the name of conversion to "Christianity"? Did you notice how in the old testament when Pharaoh kills all of the male babies, in an attempt to whack Moses, it's bad, and when Herod does it, trying to whack Jesus, it's bad, but when the "angel of death" does it, it's good?

Do you even use your brain? Do you even have one? Do you realize that a "Constitutional Amendment" which cancels the 1st amendment's protections of Islam will put this country on a slippery slope the magnitude of which will end 1st amendment protections for ALMOST every faith, except for the one which will be sanctioned by the state?

If not, then STFU!

Since Jews are COMMANDED by their "god" to inflict their beliefs and their "laws" on others, in direct contradiction of the protections of our constitution regarding freedom of religion, should practioners of Judaism be denied their 1st amendment "rights" to deny their fellow Americans of THEIR rights?

With respect G-d's commandments, all of humanity is divided into two general classifications: the Children of Israel and the Children of Noah.

The Children of Israel are the Jews, the descendants of the Patriarch Jacob. They are commanded to fulfill the 613 commandments of the Torah.

The Children of Noah are the Gentiles, comprising the seventy nations of the world. They are commanded concerning the Seven Universal Laws, also known as the Seven Laws of the Children of Noah or the Seven Noahide Laws.

These Seven Universal Laws pertain to:

1. Avodah Zarah: Prohibition on idolatry.
2. Birchat HaShem: Prohibition on blasphemy and cursing the Name of G-d.
3. Shefichat Damim: Prohibition on murder.
4. Gezel: Prohibition on robbery and theft.
5. Gilui Arayot: Prohibition on immorality and forbidden sexual relations.
6. Ever Min HaChay: Prohibition on removing and eating a limb from a live animal.
7. Dinim: Requirement to establish a justice system and courts of law to enforce the other 6 laws.
Men and women are equal in their responsibility to observe the Seven Universal Laws.

When a Gentile resolves to fulfill the Seven Universal Laws, his or her soul is elevated. This person becomes one of the "Chasidei Umot Haolam" (Pious Ones of the Nations) and receives a share of the World to Come. The Torah calls one who accepts the yoke of fulfilling the Seven Universal Laws a "Ger Toshav" (a Proselyte of the Gate).

This person is permitted to live in the land of Israel and to enter to the Holy Temple in Jerusalem and to offer sacrifices to the G-d of Israel.

If a Gentile wishes to accept the full responsibility of the Torah and the 613 commandments, he or she can convert and become a Jew in every respect.

It is a principle of Judaism, however, not to seek converts and one who requests conversion is generally discouraged. Should the person persist in his or her desire to convert, counsel should be taken only with an Orthodox Rabbi or Torah Scholar, for conversion not in accord with Halacha - Torah Law - is no conversion at all, and conversion bestowed by "rabbis" who themselves do not follow the Laws of the Torah are null and void, neither recognized in heaven nor by any G-d-fearing Jew.

It is incorrect to think that since the Children of Israel have 613 commandments and the Children of Noah have seven commandments, that the ratio of spiritual worth is proportionally 613 to seven.

The Seven Universal Laws are general commandments, each containing many parts and details, whereas the 613 Commandments of the Torah are specific, each relating to one basic detail of the Divine Law. Therefore, the numerical disparity in no way reflects the relative spiritual worth of the two systems of commandments.

Besides the Seven Universal Laws, the Children of Noah have traditionally taken it upon themselves to fulfill the commandment of honoring mother and father, and the commandment of giving charity.

If a Noahide who follows the Seven Universal Laws gives charity, the Israelites accept it from him, and give it to the poor of Israel since through the merit of giving charity to the poor among the Jewish people one is given life by G-d and saved from death. But a Gentile who does not accept the yoke of the Seven Noahide Laws and gives charity is not permitted to give it to the needy of Israel. His charity may be given only to poor Gentiles.

By observing the Seven Universal Laws, mankind is given the means by which it can perfect itself.

The individual, through these laws, has the power to refine his essential being, and can reach higher and higher without limit. For it is written,
"I call heaven and earth to bear witness, that any individual, man or woman, Jew or Gentile, freeman or slave, can have the Holy Spirit bestowed upon him. It all depends on his deeds."
(Shaare Tzedek 60a, 60b)

The Jew's Role

It is through the observance of the Seven Noachide Laws that the entire world becomes a decent, productive place, a fitting receptacle for the Divine.

The Rambam explicitly rules (Code, Kings 8:10):
"Moshe Rabbeinu commanded from the mouth of G-d to convince all the inhabitants of the world to observe the commandments given to the Children of Noach."

It is the Jew's duty to see to it that all peoples lead the righteous and decent life which comes from compliance with the Seven Noachide Laws. Not only is it a Jew's duty because he has been so commanded by G-d, but it is also to his own benefit.

I would however support an amendment that simply states:

No religious law shall ever supercede state and federal laws or be considered legal or applicable for enforcement in any way within the Republic of the United States of America.

That should cover it. No need for all the long statements and drawn out explanations. Simple and to the point is the best way.

Snarky: you are obviously an idiot. The whole point is that no religion should be able to impose its laws on the whole population.

It is called Separation of Church and State.

I don't care if someone wants to worship green cows and blue frogs as long as they don't have the power to enforce a law that requires me to do it.

If you allow the laws of one religion to become the law of the land, then you have to allow the laws of all religions to also be enforced. Nobody wants that.

Worship any way you want to. That is what freedom of religion is.

The danger of Islam is that there is no recognition of any separation between relgious laws and state laws. So if they ever became a majority in the USA, they could decide that their religious laws must be our state laws. Would you be happy with that?

Obviously not. So it is better to say that no religious law shall supercede any state or federal laws so everyone is free of them and can follow whatever religious laws they choose to follow from any religion.

You're right, I'm dumb, since you're saying that basically repealing part of the 1st amendment will make the world a safer place to practice religion. Hypothetical situation, there's a church which believes that their sacrament must be done through the smoking of marijuana, which happens to be against federal/state and local law. Under your wonderful ideal, the people who (whether right or wrong) believe that the gateway to heaven will only open if they smoke weed, will be damned to hell, or so they'll think. No OVERT religion in America has any power to impose its beliefs on non-members, accept in Utah, so by your own explanation your law is unnecessary.

So how's about a nice steaming cup of stfu
