If a judge authorizes surveillance of communications on reasonable grounds, the authorization isn't retroactively illegal just because the surveillance doesn't lead to an indictment. Jut like if the police have a search warrant and find nothing ... the search was still legal.

He's got a law background, he should therefore know that, even if he claims that he himself did not endorse it, the agencies that work for government do not act alone unless there is hard evidence, and the reasoning to probe Trump in this way is therefore the responsibility of POTUS. The judges must themselves state the full evidence and/or the source.

Obama would fair better if he came clean that he was just snooping on Trump for the purposes of affecting the election.

They used a flimsy excuse of a private server located in Trump tower that had communications with two russian banks. They had to remove Trumps name since they couldn't prove it was Trumps server and then the FISA was granted. Now, anyone with a brain knows space is rented in Trump tower to many businesses and many individuals. This server could have belonged to anyone. The bank communications could have been spam for all anyone knows. It was a flimsy excuse used to gain access to Trump. That is the scandal.

Everyone's phone is tapped. It's no secret, the NSA has all our communications. Is this where Trump is going - that he just learned the NSA tapped his phone when he learned it taps EVERYONE'S phone? If so, that argument doesn't carry any weight.

A deeply buried detail in today’s New York Times article on the subject has huge implications for Trump and his team:

But a senior White House official said that Donald F. McGahn II, the president’s chief counsel, was working on Saturday to secure access to what Mr. McGahn believed was an order issued by the Foreign Intelligence Surveillance Court authorizing some form of surveillance related to Mr. Trump and his associates.

The official offered no evidence to support the notion that such an order exists. If one does, it would be highly unusual for a White House to order the Justice Department to turn over such an investigative document, given the traditional independence of law enforcement matters.

This is extremely important for two reasons.
Even if it doesn’t exist, the fact that it has spooked the White House enough to go looking for the FISA warrant is an admission of guilt in itself.

If it does exist, as the White House counsel clearly believes it does, it means that three federal judges had enough evidence that Donald Trump’s election campaign was infiltrated by foreign agents to issue a wiretap. 
Secondly, it is a huge breach of protocol for the White House to interfere with an ongoing Department of Justice investigation. While not technically illegal, it is extremely unethical for the White House counsel to be meddling in the affairs of the DOJ, especially when the investigation is targeted at members of the current administration.

LOL. That's quite a contortion of the story. Obummers DoJ would have destroyed any paper or electronic trails. They had plenty of time to do it.

The evidence is all the newspaper stories going a year back from a variety of sources (NYT, WaPO, etc.) documenting the actions, sourcing wiretap info and claiming info from Executive branch officials, even WH officials.

The second FISA was granted based on flimsy evidence in order to spy on a political opponent. FISA is rarely denied and is the easiest to get (meaning no hard evidence). Just the fact that it's been going on for freaking ever and nothing has been found shows the D party failed and their theory was wrong. I contend it was used as an excuse to spy and get dirt to bring Trump down and it is looking more and more like that. No October surprise for you DEMS!
