If it's known the woman's intent was to not deliver the child, then likely not However she can recover damages for how traumatic the experience was for her as it didn't happen in the way she desired and is now emotionally scarred. Not to mention that the guy is drinking and that's an aggregate risk factor. She would get money from his insurance company for sure, but as far as going after his assets once the policy is maxed out....doubt it |
