I have a question that has been bothering me. I have no bias for or against Bill Cosby, I don't know what happened. My question is in regards to our judicial system as a whole.

Can anyone tell me why a hung jury is not an acquittal? If you are innocent until proven guilty, then doesn't a hung jury mean that the prosecutors failed to prove their case? If you must be proven guilty beyond a reasonable doubt, doesn't disagreement among the juries mean there is reasonable doubt?

Are the concepts of "innocent until proven guilty" and "beyond a reasonable doubt" myths in our system?

Every member of the jury has to agree on one verdict. They dont have to agree on the reasons for the verdict. They just have to agree on guilty or not guilty.

Every juror has to agree that there is reasonable doubt in order to agree to s not guilty verdict. They can each have a different reasonable doubt.

This doesnt affect innocent until proven guilty. A defendant does not need to be proven innocent. So long as one juror sees reasonable doubt there can be no conviction.

As of today, Cosby is innocent. He hadnt been convicted or aquited. The prosecution may decide against s retrial. He is still innocent, even though never aquited.

It's not an acquittal because it's not unanimous. Obviously it's not a conviction either.

So the prosecution get to do over if they want to. Usually they look at the split in the Jury how many wanted to convict and how many said not guilty. Then they talk to the jurors and they decide if they have a good case to do it again.
