Actually, now that I think about it, you're right. You can call on your cell phone and verify with the police station that it is a real cop. They all have to call in their stops.

I remember a story about this topic a couple of years ago; the assertion was that your vehicle is YOUR private property and that you don't have to exit unless it's very clear that a crime has been committed; the murky part involved the ground your car was parked-upon -whether it was private or public property.

In this same story there was an account of a woman who went toe-to-toe with an officer who had stopped her; in reply to his request, she locked her doors and rolled up her windows and began reading loudly from a copy of the U.S. Constitution [she was a long-term activist and may have set the entire incident up to establish a precedent!]; the cop called for reinforcements and they broke into her car and dragged her from it -even though she had committed no serious offense. As I recall: when her case was presented in court, the Judge dismissed all charges against her BUT the officers were NOT reprimanded in any way, and she still had to fix her damaged car at her own expense.

If you are an American, you have no rights that will protect you against a policeman with a gun. The best thing you can do is

1) Buy the most expensive car you can afford.

2) Make it clear that you are either a lawyer yourself or can afford the best in the business.

I was stopped by two traffic policemen a few months ago and told them "I don't need any more of your cheek" because they were overplaying their hand and being childish. They apologised. I wouldn't have done that in America. I live in the UK.

It amazes me that Americans believe they live in a free society when the police can get away with treating people like dogs.

When a police officer stops you, he is basing his stop on a reasonable suspicion or probable cause for some type of civil infraction, misdemeanor or felony he just observed.

Furthermore, it is done for his safety and yours.

Cutting to the chase, right to the chase, cooperate with him, and if need be asked him why were you stopped.

If there is a disagreement, tell him so cordially.

If complications arise from the stop, address your grievance before a judge.

If your rights have been seriously violated, seek legal council......OK

NOW, on the other hand, if you wanta play tough guy and get down and dirty...."it`s all good", they`ll accommodate you.

The above is generally a pack of lies.

1) The police routinely set up traffic blockages, and stop every car and question every driver. No reasonable suspicion is present or required.

2) Police act for a variety of motivations. Even besides the obviously nefarious one of ticket quotas, there is the more insidious one of 'investigating an anonymous tip'. At best, the tip is garbled in the multiple handoffs from phone dispatcher to traffic cop; at worst, the tip is a deliberately false report intended to harm an innocent person.

Not long ago the media described a case in which a report of money lost from a wallet turned into a brutal manhunt for a bank robber. Luckily in this case, only the dog ended up shot to death--it could just as easily have been an innocent human.

3) It is certainly foolish to 'cooperate' with someone who is demanding that you act like a circus clown (via the intoxication test 'exercises'). The only reasons to do so are if you are legally required to (which is unlikely), or if the police officer will otherwise assault you or plant evidence on you (which is highly likely).

4) It is unfortunate but true that in American society, if a police officer is beating you to a pulp without cause, you can nevertheless be prosecuted for resisting in any way. Legally, you must let him beat you up or even kill you without offering any resistance. As the poster above says, your next-of-kin may be permitted to file a grievance later.

5) Any police officer who demands that someone act like a circus clown is certainly not showing respect, but rather abusing his authority. Nevertheless, the citizen must show respect for the officer, not because he deserves it but because the citizen will be beaten up if he doesn't.

6) We must all remember that by its nature, police work attracts the kind of personality that wants to order other people around.

Does this mean that all police officers are bad? No. However, the good police officers will generally defend the bad ones, unless the offense is egregious and clearly undeniable.

I wouldn't, a person who refuses usually has something to hide. Most people either have drugs in the car or could be hiding a weapon of some sort which if you had a gun to the side of you, that policeman could be in danger and you could easily reach and shoot him or her. Mostly they ask you to step out if you run a red light of drive a litle madly they need you to get out to check if your stable and under any influence of drink or drugs. In which case he could of saved you from killing a young child and that's not nice on anyones concious. So the best thing is not to be shitty and just be nice and do as your told.

What I stated pertains to reasonable and prudent people as an approach to counter what they felt may have been an unreasonable stop.

What you stated is not generally bullshit, its total bullshit.

where do the cops get the false evidence that they plant in your car? do you mean to tell me that cops are driving around with contraband for this purpose? do their superior officers know about this, are they in on it too?

i've heard stories about how a cop will search you and when he searches your pockets he pulls your pocket inside out and the HE drops the contraband on the ground and then claims it was yours.

of course, his partner is i on it too, and you're alone with no witnesses. besides, two cops word in court will be taken over your word anyway.

Re: If a cop asks you to step out of the car, do you have to?
When you are pulled over, you should find a well populated area to stop with plenty of witnesses, like a busy convienience store. You are allowed by law to slowly preceed to a place your own judgement tells you it is safe to do so.

When you pull over, imeadiately get out of the vehicle CLOSE AND LOCK THE DOORS , and rotate 360 degrees. This will be on the convienience stores security camera and the cops' on board video camera, showing you're not armed, and that your car was LOCKED. This will require a warrant to legally open the vehicle and search it..

If you have witnesses in the vehicle, tell them to remain in the car unless they are placed under arrest, and inform them that they DO NOT need to speak to the officers (or put down windows or open locked doors) UNLESS they are placed under arrest. DO NOT ALLOW SEARCHES EVEN IF YOU ARE NOT CARRYING CONTRABAN, they WILL plant it on you if they're in the mood. It's not uncommon for a cop to shoot an innocent, guiltless person and throw down a weapon and sprinkle a little crack on 'em, just for the hell of it.

I know this sounds a little extreme, but police are killing innocent people for whatever reason, and the problem is getting pretty frightening. Police are being trained to precieve ordinary people as the enemy. The police ARE the enemy, the only thing they fear is the fat cats, and they are picked for thier lack of intelligence.

The old saying, " i wanted to be a cop but i was too smart" is not just a joke, it's a reality. If cops were smart they wouldn't serve what they do!

Yes. You are obligated to follow a lawful order. Car stops are the most dangerous thing they do. Notice when they come up they have a hand on their weapon? Not a good time to resist or pick a fight. You can fight the stop later. Also you won't have any holes in you to worry about.

Hi there , lawful and legal are 2 different things !!! you can ask the cop if you have a choice and if he says no then tell him you are under protest and duress meaning whatever he makes you do he is now liable for it and anything signed is void . you can learn more at thinkfree.ca and tpuc.org Cheers!!

There have been a few stops in front of my house these past few weeks and what I notice is they shout through a bullhorn and tell the driver to shut off the car, put the keys on the roof of the car and remain inside. Then they saunter over, hands on gun, and request the usual license and registration and take the keys. Back to the cruiser to do their check, then they'll come back and tell the person to get out of the car (in most cases I've seen). I've seen some cases where they just wrote a ticket or talked to the person and there was no time in which they had the 'victim' outside of the vehicle.

Yes.

During my tour of duty as a cop for 25 years...step out.... and do yourself and myself a favor.

I want to see hands, no exception.

If the occupants did not step out, I would call for a tow truck and tow all the occupants while their inside the vehicle, to the station.

At the station all occupants would have to show valid I.D. before being released.

Usually, if not always, the occupants had warrants outstanding, were fleeing from justice or were fugitives on the lamb.

In any case, no one leaves, until their positively I.D.

That said there is a towing bill around $100 bucks or so.

So step out of the car and just talk to the officer...most probably he will just walk away without incident.

Now for those of you who feel you must resist....you can have it your way.

First you should ask him under what authority he is asking you to do so and why he is seizing you and your property without a proper warrant issued by a judge or magistrate, which requires a signed affidavit of a complaint in order to be issued(Pennsylvania Code)according to the state code. If he asks you for your drivers license you should ask him if you are required by law to have one. If he states yes ask him what the law is. If he cannot state the law, which does not exist, then how can he be operating under proper authority. He cannot. If he says the license is required by law and knows that it is not he has just committed fraud under 18 USC 1001. Either way if you refuse and he does not let you go and gets aggressive you should operate under protest and duress and then sue for the damages caused as a result of the violation of your God given rights which are secured by the Constitution for the united States of America. Peace and justice for all.
