Volusia County election records just got put on lockdown
Dueling lawyers, election officials gnashing teeth, Votergate.tv film crew catching it all.
Here´s what happened so far:
Friday Black Box Voting investigators Andy Stephenson and Kathleen Wynne popped in to ask for some records. They were rebuffed by an elections official named Denise. Bev Harris called on the cell phone from investigations in downstate Florida, and told Volusia County Elections Supervisor Deanie Lowe that Black Box Voting would be in to pick up our Nov. 2 Freedom of Information request, or would file for a hand recount. "No, Bev, please don´t do that!" she exclaimed. But this is the way it has to be, folks. We didn´t back down.
Monday Bev, Andy and Kathleen came in with a film crew and asked for the FOIA request. Deanie Lowe gave it to us with a smile, but I noticed that one item, the polling place tapes, were not copies of the real ones, but instead were new printouts, done on Nov. 15, and not signed by anyone.
I asked to see the real ones, and they told us for "privacy" reasons we can´t have copies of the signed ones. I insisted on at least viewing them (although refusing to give us copies of the signatures is not legally defensible, according to our attorney). They said the real ones were in the County Elections warehouse. It was quittin´ time and we arranged to come back this morning to review them.
Lana Hires, a Volusia County employee who gained some notoriety in an election 2000 Diebold memo, where she asked for an explanation of minus 16,022 votes for Gore, so she wouldn´t have to stand there "looking dumb" when the auditor came in, was particularly unhappy about seeing the Black Box Voting investigators in the office. She vigorously shook her head when Deanie Lowe suggested going to the warehouse.
Kathleen Wynne and Bev Harris showed up at the warehouse at 8:15 Tuesday morning, Nov. 16. There was Lana Hires looking especially gruff, yet surprised. She ordered them out. Well, they couldn´t see why because there she was, with a couple other people, handling the original poll tapes. You know, the ones with the signatures on them. Harris and Wynne stepped out and Volusia County officials promptly shut the door.
There was a trash bag on the porch outside the door. Harris looked into it and what do you know, but there were poll tapes in there. They came out and glared at Harris and Wynne, who drove away a small bit, and then videotaped the license plates of the two vehicles marked ´City Council´ member. Others came out to glare and soon all doors were slammed.
So, Harris and Wynne went and parked behind a bus to see what they would do next. They pulled out some large pylons, which blocked the door. Harris decided to go look at the garbage some more while Wynne videotaped. A man who identified himself as "Pete" came out and Harris immediately wrote a public records request for the contents of the garbage bag, which also contained ballots -- real ones, but not filled out.
A brief tug of war occurred, tearing the garbage bag open. Harris and Wynne then looked through it, as Pete looked on. He was quite friendly.
Black Box Voting collected various poll tapes and other information and asked if they could copy it, for the public records request. "You won´t be going anywhere," said Pete. "The deputy is on his way."
Yes, not one but two police cars came up and then two county elections officials, and everyone stood around discussing the merits of the "black bag" public records request.
The police finally let Harris and Wynne go, about the time the Votergate.tv film crew arrived, and everyone trooped off to the elections office. There, the plot thickened.
Black Box Voting began to compare the special printouts given in the FOIA request with the signed polling tapes from election night. Lo and behold, some were missing. By this time, Black Box Voting investigator Andy Stephenson had joined the group at Volusia County. Some polling place tapes didn´t match. In fact, in one location, precinct 215, an African-American precinct, the votes were off by hundreds, in favor of George W. Bush and other Republicans.
Hmm. Which was right? The polling tape Volusia gave to Black Box Voting, specially printed on Nov. 15, without signatures, or the ones with signatures, printed on Nov. 2, with up to 8 signatures per tape?
Well, then it became even more interesting. A Volusia employee boxed up some items from an office containing Lana Hires´ desk, which appeared to contain -- you guessed it -- polling place tapes. The employee took them to the back of the building and disappeared.
Then, Ellen B., a voting integrity advocate from Broward County, Florida, and Susan, from Volusia, decided now would be a good time to go through the trash at the elections office. Lo and behold, they found all kinds of memos and some polling place tapes, fresh from Volusia elections office.
So, Black Box Voting compared these with the Nov. 2 signed ones and the "special´ ones from Nov. 15 given, unsigned, finding several of the MISSING poll tapes. There they were: In the garbage.
So, Wynne went to the car and got the polling place tapes she had pulled from the warehouse garbage. My my my. There were not only discrepancies, but a polling place tape that was signed by six officials.
This was a bit disturbing, since the employees there had said that bag was destined for the shredder.
By now, a county lawyer had appeared on the scene, suddenly threatening to charge Black Box Voting extra for the time spent looking at the real stuff Volusia had withheld earlier. Other lawyers appeared, phoned, people had meetings, Lana glowered at everyone, and someone shut the door in the office holding the GEMS server.
Black Box Voting investigator Andy Stephenson then went to get the Diebold "GEMS" central server locked down. He also got the memory cards locked down and secured, much to the dismay of Lana. They were scattered around unsecured in any way before that.
Everyone agreed to convene tomorrow morning, to further audit, discuss the hand count that Black Box Voting will require of Volusia County, and of course, it is time to talk about contesting the election in Volusia. |

The reason Bush is moving so swiftly is to cement his election in the minds of American voters, and prevent any counter-actions by his adversaries. Kerry is now a distant past, Bush and his cohorts are in the process of establishing a form of dictatorship. Don´t look for what this article suggests. We are being prepped for the police state and consequent readjustment of our country, politcally, economically, and sociologically. Things will continue to accelerate and happen daily. The idea is to create so much change so quickly, the mind and thus the individual will not be able to adjust to the rapid changes, so as to nullify any effective counter-measures. Expect to see more rapid advances of our troops into more campaigns each week until it is too late to dissent. The coming changes to our economy will be so great, that any of the military actions will pale in significance. The next blitz will be in the courts and directed by our new Attorney General. The Supreme Cout appointments will create a new court which will provide the necessary implementation of decesions (both in the administration and the Congress) to accomplish all ot this. The other cabinet position changes will accomplish the same rapid changes in those areas of our lives as well.
These are just a few of my opinions.
And, since you did not ask for them, please feel free to discard them altogether. I understand it is hard to accept the belief our elected leaders and their appointed assistants are not really acting in our (the general public) best interests. That we are being led to slaughter as a people and as a nation. But, that is exacltly what I see happening. This is all so dour and dire our natural inclination is to reject it. And, that is just what the cartel directing these scenarios are counting on to ensure their successes. The one element that cannot be controlled however, our spirituality and collective consciousness, will prevail. Just as in those dark hours of our past, the birth of our nation and the struggles of our civil war, our strength of character and trust in a higher power will bring with it a new beginning. We must strive all the harder to keep in touch with one another, continue to share our pieces of information, share our resources and support one another whenever possible. We must remain united in the midst of all this division.

Subject: Coalition Kerry Could Un-Concede? Fw: Preparation for UNconcession
Dear Roy, thought you would like to know about this-----
This came to me tonight from a lawyer friend:
BREAKING---KERRY TO UNCONCEDE IF THERE IS EVIDENCE OF FRAUD
FORWARD TO EVERYONE YOU KNOW
EMAIL FROM DC LAWYER CYNTHIA BUTLER
I am angry and getting emails and recrimination from people wondering why KERRY just caved and is not fighting this before the final count in Ohio, before any of the fraud was challenged, before New Mexico and Iowa even came in.
There is widespread feeling that he did not lose the election and that it was taken from him.
There is enough here to warrant investigation and enough to challenge the results. It´s coming from all corners.
I understand that he has until the official count certification in Ohio to Un Concede which is several days from now.
Anyone who thinks that he should unconcede should give reasons why - whatever they noticed, particularly in Red Republican Governed States using electronic machines- and send them directly to Cameron KERRY, John Kerry´s brother at his law firm at the address CKerry@Mintz.com
They should inform us if they were not allowed to vote provisionally (for whatever reason- they lost forms, ran out of forms, etc.) I personally witnessed a number of things as I reported in Texas with the DCCC. (Democratic Congressional Campaign Committee)
If you know anyone in particular in Ohio who tried to vote and was turned away at the polls please get their information and notify the campaign.
They should be notified if they experienced lines longer than four hours-particularly elderly or infirm people (we call that torture when they do it to political prisoners) . They should be notified if people were told as has been reported that due to too many people showing up in African American precincts, particularly in Ohio where there were too few booths (some only had two or three for the entire precinct) and told because of heavy turn out they could vote on Wednesday. If the numbers of these sorts of incidents creates a percentage margin that exceeds the margin of victory- Un Concession has to be made to challenge the count.
If people wanted to and tried to vote and were prevented or actively discouraged from doing so, that is a Civil Rights matter and must be dealt with in terms of the ultimate count.
This is the last email that I am writing on this subject in this venue. I am taking it up in other venues.
Please pass along this to your listservs so that we may make Democracy Work in America. We are not a country where he who cheats best wins.

Anonymous Coward 12/8/2005 10:17 AM | | Re: VOLUSIA COUNTY ELECTION RESULTS JUST GOT PUT ON LOCKDOWN | Quote | All of this complaining is pretty useless. I guess the thought shit or get off the pot comes to mind. How about some constructive advice on how to change things or what organizations to get involved with that *might* actually do soemthing... like slow up clear cutting or pollution or improve the public education system in your neighborhood.
We have been beat like a gong. One of the most ignorant men in sometime holds power... and alot of it, all 3 parts of the Government infact. So really the time for whining and complaining is over. We have four more years of baby Bush and perhaps 8 more of Jeb coming in right behind him.
Really it is pretty much like a tsunami one horrible wave and a few more ugly ones behind it.
So at this point it is either shut up and accept it, do something to try to slow the devistation down or move out of the country... but just talking about it over and over and over again for the most part is pretty useless. Being informed and sharing the depression and horror with everyone is great ;) knowledge is the ticket but only if you are going to do something with/about it.
PS: The Canada site was nice but there is a 2 year waiting list to even get to your application and a $1,400 application fee per person if you are accepted or not.
pps: MCSquane: Stay and fight awesome, perhaps you would like to share exactly how you plan on doing this. I am sure many inquiring minds would love to know. |

Problem 12/8/2005 10:17 AM | | Re: VOLUSIA COUNTY ELECTION RESULTS JUST GOT PUT ON LOCKDOWN | Quote | What exactly is the problem
Why the lawyers
Why the lock out.
This is not top secret its an election, fair honest and open. So why not show the signed voter tallies. Why not indeed.
Why call the cops and lawyers to stop people exercising their rights. Why indeed.
This MUST be answered.
Nothing to do with accept it, dems vs repubs
Its about fundamental rights. |

It is about shining the light to the WORLD that our elections were, without a doubt, crooked, and that the resnubs stole the election and installed a hitlerian regime. Let the world know. Let US know. Then we can get on with whatever ´plans´ the blackboots have in store for us....at least SOMETHING will be out in the open. |

Anonymous Coward 12/8/2005 10:17 AM | | Re: VOLUSIA COUNTY ELECTION RESULTS JUST GOT PUT ON LOCKDOWN | Quote | you have to ask-WHY would they want to count those votes in secret-away from the prying eyes of the media and the poll watchers?
-------------------
(AP) Nov 15, 2004
The rationale for the bizarre “lockdown” of the vote-counting venue in Warren County on election night suddenly broke down when it was contradicted by spokespersons from the FBI and Ohio’s primary homeland security official.
County Emergency Services Director Frank Young said last week that in a face-to-face meeting with an FBI agent, (whom he declined to name), he was warned that Warren County, outside Cincinnati, faced a “terrorist threat.” County Commissioners President Pat South amplified, insisting to us at Countdown that her jurisdiction had received a series of memos from Homeland Security about the threat. “These memos were sent out statewide, not just to Warren County, and they included a lot of planning tools and resources to use for election day security.
“In a face to face meeting between the FBI and our director of Emergency Services,” Ms. South continued, “we were informed that on a scale from 1 to 10, the tri-state area of Southwest Ohio was ranked at a high 8 to a low 9 in terms of security risk. Warren County in particular, was rated at 10.”
But the Bureau says it issued no such warning.
“The FBI DID NOT notify anyone in Warren County of any specific terrorist threat to Warren County before Election Day,” FBI spokesman Michael Brooks told Cincinatti Enquirer reporters Erica Solvig and Dan Horn.
Through a spokeswoman, Ohio Public Safety Director Ken Morckel also told this newspaper that his office knew of no heightened terror warning for election night for Warren County or any other community in Greater Cincinnati, either.
Despite the contradiction from both security services, Ms. South again nervously recounted the story, telling the Enquirer “It wasn’t international terrorism that we were in fear of; it was more domestic terrorism.”
(Mr Young and Ms. South are Republicans)
So the media was kept two floors away from the vote counting at the Warren County Administration on election night on the basis of a false “10” FBI terror threat that the FBI says was never issued.
Sounds like a great way to monkey with the ballot totals without any prying eyes.

You nailed that’s what it’s all about! The current machines can NOT be trusted as there is no hard copy to verify the actual votes. There is no possible way we could ever make a true audit. Hell, big businesses and banks have everything baked up with a hard copy on paper. To have an election with a paperless ballot is simply retarded. But the is a better machine that has it all! After voting you can even look it up on the net to see if it was counted. This could have been in place for the 2004 election but for some odd reason we went with the retarded method.
