The Teamsters Union on Wednesday asked the 9th U.S. Circuit Court of Appeals to stop the program, which could go into effect as early as Saturday. The union argues that the administration plan, which would let as many as 100 registered Mexican trucks deliver their cargo anywhere in the country for the next year as part of a "demonstration program," would endanger public highways because safety issues have not been resolved. But in its filing Thursday, government lawyers said the trucks enrolled in the program meet U.S. trucking regulations and the program is a necessary part of the North American Free Trade Agreement. "Participating Mexican carriers must comply with all legal requirements governing operations of domestically owned carriers, and in some cases stricter requirements," wrote Assistant Attorney General Peter Keisler. The Teamsters union says it was told by FMCSA officials that the government agency intends to grant authority on Sept. 1 for Mexican trucks to drive beyond the 15-mile border zone throughout the entire United States. "What a slap in the face to American workers -- opening the highways to dangerous trucks on Labor Day weekend, one of the busiest driving weekends of the year," said Teamsters General President Jim Hoffa. The pilot project involves 100 selected Mexican carriers, representing about 1,000 trucks. Congress recently voted to block the program until the DOT's Inspector General has finished the project. The IG has reportedly finished a preliminary audit, finding that the agency has improved the safety program, but a second report examining the data the FMCSA will use to monitor Mexican trucks has still not been released. That second report is expected by the end of the week. The Teamsters, along with the Sierra Club, Public Citizen, and the Owner-Operator Independent Drivers Association have filed a request for an injunction against the FMCSA's plan to proceed this weekend. "I am honestly stunned by the Administration's contempt toward the American public, Congress and the rule of law," said Todd Spencer, executive vice-president of OOIDA. "They are determined to open our highways to Mexico-domiciled trucking companies regardless of the public’s concerns and what’s in the law books. Congress responded to concerns about the safety and security implications of this pilot program. It is truly amazing that the Administration is choosing to ignore Congress and the people they were elected to represent." The groups insist the government create a program that yields statistically valid findings; show that U.S. trucks have the same right to travel in Mexico that Mexican-domiciled trucks have in the U.S.; and reveal the inspection results for motor carriers allowed to drive beyond the border zone. In a statement, FMCSA said it is reviewing the suit and will respond to the court shortly. The agency added that the lawsuit is without merit and that its program will benefit consumers by reducing the costly practice of requiring cross-border shipments to be transferred onto separate trucks operated by different drivers. |

The 9th U.S. Circuit Court of Appeals in San Francisco said the Teamsters and other groups suing hadn't met the legal requirements to justify blocking the program. "This is the wrong decision for American working men and women. We will now proceed to litigate this case on the merits," Teamsters General President James Hoffa said in a statement. "We believe this program clearly breaks the law. We will continue to fight for safety and national security in the courts and in Congress." Current rules require freight from Mexico to be transferred to U.S. trucks and drivers in the U.S. Under a one-year U.S. pilot program, Mexican trucking companies could move shipments around the U.S. themselves, saving time and money. The program was supposed to start as soon as Thursday. The Teamsters union, representing 100,000 long-haul truckers, and the Sierra Club and other public advocacy groups asked the court Wednesday to put the plan on hold until they receive more assurances that the vehicles comply with U.S. environmental, security and safety regulations and that U.S. truckers would get reciprocal rights to travel in Mexico. The U.S. Transportation Department said in a Thursday court filing that Mexican trucks will be pre-screened and inspected for safety before being allowed to travel in the U.S. Mexico promised to reciprocate for U.S. trucks, the agency said. Forty-four trucks from Mexico are expected to participate in the program during the first 30 days, the U.S. said in the filing.
