Psychology Board Investigates Dr. Phil.

TMZ has obtained a copy of a complaint against Dr. Phil which was lodged with the California Board of Psychology, alleging the TV doc was illegally practicing without a license when he paid a visit to one Britney Spears. Dr. Phil has never been licensed to practice in California, and he retired his Texas license in 2006. Practicing without a license is a felony in California.

Otherwise he is only giving advice, regardless of what they believe at the time, unless he flatly stated that this was psychological advise for medical purposes.

It is easy for people to claim a person is practicing something without a license and harder to prove in court.

For instance, it is not considered practicing medicine if I suggest that the pain in your side may be appendicitis.

That is just me giving my opinion.

If I try to cut it out for you however, that would be practicing medicine.

If I use my psychic abilities to help repair your appendix however, that may not be considered practicing medicine without a license, depending on the area you live in!

In almost all areas, non-medical procedures that are not tracked at all by the FDA are legal to preform. (As long as you don't claim you are practicing medicine. Even if you are fixing medical things... It is a messed up system!)(So, no one can sell you medicine to fix your appendix without a doctor's order, nor can they cut your appendix out, but they can take money to pray over it, lay hands on it, use reiki or meditate at it, as these are not areas that the FDA regulates at all.) (Though if you insist on prayer, and a person dies, you could be held responsible, just as a word of warning.)

In Doc. Phil's case, he was likely acting as a show host, not a doctor. This will get him off the hook.
