Anonymous Coward User ID: 399681 United States 04/14/2008 12:21 AM Report Abusive Post Report Copyright Violation | Is there a date for a sherrif sale yet.. have you received the notice.. In my county you can check the website and you can see how far off it would be if not scheduled yet.. this will give you an idea of how much time you have left.. If you don't care about your credit.. File a chapter 7 .. to stall it.. I don't really know exactly where you are with the mortgage co.. call a chapter 7 lawyer.. a good one, they maybe able to give you a time frame.. I filed chapter 7 in Septemeber and i am still in my house.. I have no idea what is going on my mortgage co.. doesn't either... I keep checking my sherrifs dept and the sherrifs sale are allready up to June20, so i am thinking i have that long and I've also learned that it takes maybe six weeks after the sherrif sale to kick you out.. GOOD LUCK! |

His new company is better to him, more job security but crappy wage. same industry though. God never gives you anything that you can't handle. So buck up and handle your shit! |

I'd like leave the country and live as an illegal alien somewhere else. The only real cure to this increasing problem for many. |

Anonymous Coward User ID: 353013 United States 04/14/2008 12:39 AM Report Abusive Post Report Copyright Violation | Take anything of value that you own and put it in storage with a trusted friend or relative, or have them rent a storage locker in their name. All your belongings can be seized when the sheriff finally comes knocking. That being said, however, it takes a long time to get evicted. Why haven't you spent some time researching this before now? Surely you have known you had a major problem looming. You need to get up to speed on this, google is your friend, do as much research as you can and remember that the laws for one state are not the laws for another state. Have you looked into your state's government-backed programs? California has huge programs in place with websites and personnel to help homeowners in trouble. Maybe your state has something similar. [link to www.gov.ca.gov] [link to www.yourhome.ca.gov] Maybe you can get some ideas at their website even if you are in a different state. Try to protect yourselves from homelessness at all costs...it's a very hard climb out. |
MissKitty (OP) User ID: 412757 United States 04/14/2008 12:40 AM Report Abusive Post Report Copyright Violation | no I am looking for a legal way out. I want a better life for my kids and we can't afford the house. I will never buy a house again. Documents were changed at signing. Interest rate soared. they screwed us. We have tried everything that we could think of to keep the house, nothing has worked. So we want enough time to save up so that we aren't homeless, is that TOO MUCH to ask? God never gives you anything that you can't handle. So buck up and handle your shit! |

I don't want our house, we are moving out of state anyway for a new job. We can't recover any money on our home so it is pointless to sell. We need a little more time before we move out to save up. Any advice? Quoting: MissKittyHey kitty, I'm a real estate invester i buy foreclosed homes! What you want to do is sell your house. If you run and ad: For sale forclosure house for less then appraised value!!! An investor in your area will know what to do see an investor can call your bank and make an offer directly to them for only 60% of what you owe and alot of investors will jump on that more than likely buying the property from the bank for that amount is way under the appraisal of the house! You will be able to save your credit by not having to file bankruptcy and your house won't foreclose! ;{> |

Call your bank and tell them you have a buyer even if you don't! They'll be happy with that! Either way it will buy you more time even if you don't, and prolong the foreclosure! They don't want it to foreclose as much as you don't and in most cases with these arm loans, people are able to call their banker and negotiate their rates down by threating foreclosure but your deal may be beyond that point usually it with people who are still making thier payments on time! |

Quoting: MissKittyIt'll take more than 2 months for them to evict you if you do nothing. If you want to live there without paying, insist on them presenting the ORIGINAL signed loan agreement and note in court. They can't get ownership of the house in court if you insist on them presenting it unless they have it. |
