When I worked with youth sports organizations, we could not publish pictures of the kids on the webiste without getting all parents to sign a release prior to season starting. |

Yes they can control the non-commercial use of the photo, if they chose to do this it would be in the agreement. |

Then I put the photo on my myspace. At the time the photographer had no problem with it. In fact she incorriged(sp) it. No written agreement was signed. And now, years later the photographer wants me to pay for placing it on my myspace page. I would have given you the world, if you could have only opened your heart... Quoting: jbarHe owns the right to reproduce but not to distribute for gain. If the subject of said picture is a person. Then the photographer must receive a SIGNED RELEASE from the person being photographed in order to use the picture commercially. Private use requires no release since an anyone's image is by nature 'public'. However one has the rights to perceive a profit should one's image be used to generate profit. Hence a release, waving any commercial gain on the part of the model in the picture. |

If you were a model, then they own the rights. If you didn't sign a release and weren't a model then you own the rights... UNLESS you are a recognized public official. Clinton, Obama, Bush, elected officials can't control what happens to their images. But I suppose the author could claim that by using it in a public form and not paying her that is a hit to her income. Sooo... yeah, it seems like she does have the right. But it also seems like I am bing nickel and dimed here. She said, "its only business..." Okay, so profit is an excuse to be cold and impersonal... I took it down and put up pictures I know I am allowed to use, instead. And it sucks about the public figure thing. Because I have a known person as an Artist/Musician/Producer/idiot... lols they can pretty much publish my pic in any non-profit way (so long as it is within the area that people would recognize me). Very small area, but still. I guess its true, no news is good news. Or is it, no press is bad press? who knows I'll tell you one thing. I am never going to hire a photographer that treats her clients that way. |

I do know that derivative works are still copyrighted by the original author. So long as the principal form of expression is still recognizable (and it doesn't fall under fair use policy) it becomes a matter of duel copy right. A lot of those YouTubes, simply work, because non of the authors have chosen to take a course of action (relegating them to blue law). Ideas cannot be copyrighted. But forms of expression... |
