I don’t think historical pronouns are used in court cases so yeah this person who now identifies as a woman used to identify as a man when the crime was committed. It doesn’t make sense to use a historical pronoun when referring to someone. Even though you are referring to a historical event… you are referring to someone sitting in a courtroom at the present time.

Of course… nobody is forcing anyone to use specific pronouns. That’s why anyone can say ‘they’ as a gender neutral pronoun if they (see I just used it there) aren’t comfortable using a different pronoun since ‘they’ is not only a plural pronoun but also has singular use as well.

When in doubt, use ‘they’ as a pronoun if you don’t know what someone’s gender is. I use it in work emails at the office all the time since some people have names that I don’t know if are feminine or masculine. Otherwise, it’s good to try to use a pronoun when referring to someone who tells you what pronoun they prefer.

obviously you don’t have use someone’s preferred pronoun since we have a freedom of speech and it’s not like someone his holding a gun to your head telling you to use their pronoun or they will shoot you… but it is common courtesy.
