So Bush is a lame duck dictator?
I mean explain this to me...he's done in January 09.
This act has a fail safe...not something meant to perscute people who wanna smoke weed and dis the government cuz they don't agree with the path it's on. Yet you don't mention that.
also...the crime of Conspiracy has been books forever.
Unless you've been sleeping the last 8 years or so we do actually have enemies that are operating in our country. Whom if given the chance would greatly enjoy killing as many of us as they can.
This ruling is meant for them...not us and as I mentioned...unless your building a bomb or conspiring to take down the government...it's all ok.
It amazes me how things can get so twisted.

No it doesn't have a "fail safe." All they have to do is say you're a "terrorist" and that's that. If the people they intend to detain really are terrorists, why can't they be proven as such through the justice system? Why does one man get to decide who's a "terrorist" and who's not? Why does that one man not even have to provide any proof at all? Is that justice to you? If someone is a "terrorist" let the case be presented, allow the defendant to defend him or herself, and let a jury decide what they are. No individual is infallible, no individual knows all, no individual is incapable of being corrupt. Anyone could be a "bad guy" and yet you think, in all your wisdom, that any single government official should be allowed to declare any American citizen a "terrorist" and have them hauled off, forever, to a cage and torture. That's not justice. That's called EVIL.
Are you telling me that you don't believe in fair trial? You don't believe in innocent until proven guilty? You don't believe in proof beyond a reasonable doubt? Because if so you're not only a fool, you're unAmerican. American culture includes those concepts, it's long boasted about possessing those qualities. But not only are you unAmerican, you're a traitor to this country. That's what treason is: Disloyalty. If you think one man should be able to decide who goes to jail, and not even provide evidence and allow a fair trial - you represent everything that America has claimed to oppose and to combat from its very founding. It's a circuit court decision, binding only on that circuit. It will be years or decades before it is binding on all states. If other circuit courts have heard similar cases and not ruled in opposition to the said ruling, there is no real ability to go to the supremes (conflict among circuits gets you there, but it has to be the right issue, the right case, and the right time. Are other similar cases pending?).
If there is conflict on the circuits on cases we have hope, but then it has to be a novel case. They reject those that do not pose a new (urgent) legal question. And how many people have filed, had a good attorney, and a novel or contributive case? Not many.
Some circuits (9th) have historically had a lot of losses with the supremes, but they have also added a tremendous amount to the discourse on legal issues. The board has changed, or has it?
This is an important start. As an optomist, I hope that this will start a revolution. Ok, maybe a legal revolt? or are all lawyers co-opted? Wishfull thinking. Full is better than ful. |

On July 15, the Court of Appeals for the Fourth Circuit ruled by 5 votes to 4 in the case of Al-Marri v. Pucciarelli (PDF) that the president can arrest US citizens and legal residents inside the United States and imprison them indefinitely, without charge or trial, based solely on his assertion that they are "enemy combatants." Have a little think about it, and you'll see that the Fourth Circuit judges have just endorsed dictatorial powers.
