Somehow it just doesn't seem right that if collect the seeds from plants that you have grown through the sweat of your brow and the labor of your own hands that you somehow can't use the seeds you grew ... because the orignal seeds were patented by Monsanto!?!?!? That is absurd!!

Too bad this farmer didn't challenge Monsanto with the "patent exhaustion" issue which says a companies patent exhausts after the first generation - which makes sense.

David v. Monsanto is the latest of many lawsuits against farmers (in this case, Lauren David) by Monsanto.

Monsanto is the owner of the patented herbicide Roundup and the also-patented Roundup Ready herbicide-resistant seed.

At issue in this case is David’s right to plant

Roundup Ready soybean seeds that he produced from plants grown from Roundup Ready seeds he purchased from Monsanto.

David lost the case, both at trial and at the federal circuit, and was fined $786,989. Last week, David appealed to the Supreme Court.

Presently, farmers must buy Monsanto seed annually to grow a Roundup Ready crop.

Some experts believed that a recent Supreme Court ruling on “patent exhaustion” indicated that the Supreme Court would grant David’s appeal (if patent exhaustion was the issue presented on appeal).

“Patent exhaustion” means that the “first sale” of the patent seed “exhausts” the patent owner’s rights.

Under this doctrine, Monsanto could not prevent use of its seed after the first sale.

David did not request the Supreme Court to consider the exhaustion doctrine because he did not believe the earlier ruling to be applicable because Monsanto’s license agreement restricts use of the seed — distinguishing his client’s case from the case at hand.

Some patent experts believe the Supreme Court will therefore deny the appeal. David’s lawyer strenuously disagrees.

The result? Monsanto’s right to prevent farmers from planting herbicide resistant seeds they grow from Monsanto-patented seeds will remain in place until another suitable case makes its way through the court system. This could take decades.

David’s lawyer informs me that $7.25 of the $21 cost of one “unit” of Roundup Ready seed is attributable to the Monsanto “technology fee.”

Monsanto did not respond to my calls for current price structure.

According to the Center for Food Safety, Monsanto has collected more than $21 million from farmers for seed piracy, with one farmer paying more than $3 million.

Several local farmers use Monsanto-patented seed.

Todd Irvin, a Ferguson Township soybean producer, says he plants roughly 370 acres of Monsanto’s Roundup Ready soybean.

Penn State also grows patent-protected seed from a variety of companies, including Monsanto, Pioneer, and Syngenta, according to Dennis Calvin, Penn State professor and associate director of cooperative extension.

Both said that first-generation Monsanto seed has beneficial traits other than herbicide resistance that provide incentives for farmers to not produce their own seed.

Monsanto’s seeds and genomics made up 70 percent of the company’s 2007 gross profits.

If the Supreme Court denies David’s appeal as expected, Monsanto’s profits will remain unchallenged.

This is BS. Monsanto also sues people that have never bought their seeds. Monsanto goes around spreading their seeds into the wind and when your seeds get poluted with the Monsanto genes they sue you. And the courts let them win.

If you have their corn seed don't try to sell it. and when Monsanto comes, and steps on your property to do tests, how them how good looken the end of your shot gun looks lol.

Manuel Jacob Monsanto entered into at least 12 contracts for sale of slaves between 1787 and 1789 in Natchez and New Orleans, Louisiana.1135 "His family consists of himself and seven Negroes."1136 Later, "Jacob Monsanto, son of Isaac Rodrigues Monsanto, one of the very first known Jews to settle in New Orleans, owner of a several-hundred-acre plantation at Manchac, fell in love with his slave, Mamy or Maimi William. Their daughter Sophia, grew up to be a lovely quadroon." An excerpt of one of Benjamin's many slave contracts follows:

"Be it known to all to whom these presents shall come, that I Benjamin Monsanto do really and effectually sell to Henry Manadu a negro wench named "Judy," aged Eighteen years, native of Guinea, for the sum of four hundred Dollars in all the month of January in the year one thousand Seven hundred and ninety one; and paying interest at the rate of ten per cent for the remaining two hundred and fifty Dollars until paid; said negro wench being and remaining mortgaged until final payment shall have been made; wherewith I acknowledge to be fully satisfied and content, hereby renouncing the plea of non numerata pecunia, fraud, or others in the case Whatsoever; granting formal receipt for the same. Benjamin Monsanto, sold land and "a Dwelling House, Store, and two other buildings, for which I have received payment in a negro, named 'Nat;' to my full satisfaction." Another contract stipulated "that Don Louis Faure is bound to defend the said sale in case the negro shall be claimed by any other Person." In a 1792 contract, Benjamin mortgaged his Black slaves: "I do hereby specially mortgage three slaves to me belonging, namely Eugene and Louis, aged twenty four years each, the first named of the Senegal nation and the second of the Congo nation; and a Negro Woman named Adelaide, aged twenty eight years, also of the Congo nation; which said slaves I warrant free from mortgage or other incumbrance, as I have made appear by certificate from the Recorder of mortgages; and which said slaves I promise and engage shall not be sold nor otherwise alienated during the term of this obligation..."

their patent claim is on the genetic specialty of the plant.

i would be a dick about it like they are, and file countersuit based on the fact that MY crop has, thru its growth and and adaption to circumstance, undergone genetic changes (tho they may be just minor) that make it a different strain.
