State Department Floating Ammo Import Ban...
State Department Floating Ammo Import Ban?
[link to virginiashootingsportsassociation.blogspot.com]

Friday, February 13, 2009

It looks like those who said the Obama Administration would strike while the iron is hot may have been correct, and the Administration may be doing it in a way that does not require them to even get a vote in Congress. In this morning's edition of the Shooting Wire (story below), Jim Shepherd writes that Canadian officials have it on "good authority" our State Department may be on the verge of cutting off all imports of certain calibers of ammunition.

Ammos listed for this rumored ban include the .50BMG, 7.62x39mm Soviet, 7.62x51mm NATO, .308 Winchester, 5.56 NATO and .223 Remington. Additionally, we're hearing that an expansion of this proposed ban might be broadened to include the 6.8mm SPC, 9mm Parabellum, .40 S&W, and .45 ACP- among others.

In other words, State Department officials may be floating a trial balloon to see if there are howls of protest, or whimpers of compliance. Canadian elected officials who have directed this information to me say the move seems to be motivated by "emboldened" anti-gun officials who think they have a kindred spirit in President Obama.

Shepherd continues that there may also be a plan to ban exports on certain firearms to Canada from the US, resulting in the State Department hammering gun manufacturers, distributors and exporters in the United States while simultaneously making firearms -and ammunition - ownership and acquisition more difficult for Canadians.

Many in the pro-rights community have said since the election that Obama could circumvent Congress by using regulations in his various cabinet departments to attack gun owners. It appears that it may have already begun.

Despite the fact that tomorrow's supposed to be the day to show love and affection, it looks like Canadian firearms enthusiasts aren't much in love with parts of the government right now.

The reason? A report making the rounds in Canada that says officials have it on "good authority" that our State Department may be on the verge of cutting off all imports of certain calibers of ammunition.

Additionally, Canadian officials tell me they are hearing rumblings of blanket export bans on certain firearms to Canada and the attachment of DSP-83 End Use Certificates (with their $250 Export Fee) attached to all other types of American firearms.

Should that happen, opposition leaders remind Canadian firearms owners, it will not affect European Union imports. Firearms and ammo exported from Europe would be unaffected- and certainly at far more appealing prices than comparable U-S firearms. In effect, the State Department would be hammering gun manufacturers, distributors and exporters in the United States while simultaneously making firearms -and ammunition - ownership and acquisition more difficult for Canadians. To antigun politicians, this must smell like roses. To pro-gun politicians in Canada, it smells fishy, and they're trying to drum up awareness on both sides of the border because it is "still being fought and the battle isn't over yet."

But it looks like an indirect campaign against firearms and ammo may have already begun.

You read it first here - and we'll keep you posted.

Meanwhile, back in the contiguous 48, four states are considering removing their bans on open-carry firearms. Texas, Oklahoma, South Carolina and Arkansas are each considering legislation that would remove the ban on open-carry handguns.

Surprisingly, open carry is legal in all but six states, including those where concealed carry is not. The other states that ban open carry are New York and Florida.

As expected, Paul Helmke of the Brady Center has offered his opinion on why any carry is a bad idea. "…the more guns you have in a situation," Helmke says in USA Today, "the more likely you are to have gun violence."

Nice quote, despite the fact that facts prove exactly the opposite.

These four states didn't suddenly decide to abolish their rules against open carry. In one case, Texas legislators were motivated by a groundswell of public opinion. 55,000 signatures on a petition and $25,000 in contributions for an ad campaign helped open eyes in Austin. South Carolina has a measure supported by thirty-seven legislators, while only Representative Mike Ritze (Rep.) is listed on the Oklahoma bill filed earlier this month.

No matter which side of the border you're watching, we'll keep you posted.

--Jim Shepherd

Omega, I chuckle every time I see that smilie of yours with the eagle and the fish.

Do you remember a few years back (15 years ago +/-) ... there was a news story about an airliner that was hit by a fish.
It happened (somewhere in the PacNW -- maybe Alaska), when an eagle, which was flying high with a large fish in its talons, was in the flight path of an airliner. The eagle apparently saw the "bigger bird" honing in on it, and dropped the fish, which then struck the cockpit window. Very funny, imo. :)

Re: State Department Floating Ammo Import Ban...
I posted this on another thread so you people know what the real story is in law.

Here is where the states started to license the state militias...
Keep in mind this is after the 14th Amendment was implemented and when everything went to agency and license:

Art. XI. of the Military Code of that State, Act of May 28, 1879, Laws of 1879, 192. § 5. It shall not be lawful for any body of men whatever, other than the regular organized volunteer militia of this State (Illinois), and the troops of the United States, to associate themselves together as a military company or organization, or to drill or parade with arms in any city, or town, of this State, without the license of the Governor thereof, which license may at any time be revoked...

Under the law, this guy got indicted for bareing arms:

PRESSER v. ILLINOIS.
ERROR TO THE SUPREME COURT OF THE STATE OF ILLINOIS.
Argued November 23, 24, 1885.--Decided January 4, 1886.

<clip>

The indictment charged in substance that Presser, on September 24, 1879, in the county of Cook, in the State of Illinois, "did unlawfully belong to, and did parade and drill in the city of Chicago with an unauthorized body of men with arms, who had associated themselves together as a military company and organization, without having a license from the Governor, and not being a part of, or belonging to, 'the regular organized volunteer militia' of the State of Illinois, or the troops of the United States."

A motion to quash the indictment was overruled. Presser then pleaded not guilty, and both parties having waived a jury the case was tried by the court, which found Presser guilty and sentenced him to pay a fine of $10.

The bill of exceptions taken upon the trial set out all the evidence, from which it appeared that Presser was thirty-one years old, a citizen of the United States and of the State of Illinois, and a voter; that he belonged to a society called the Lehr und Wehr Verein, a corporation organized April 16, 1875, in due form, under chapter 32, Revised Statutes of Illinois, called the General Incorporation Laws of Illinois, "for the purpose," as expressed by its certificate of association, "of improving the mental and bodily condition of its members, so as to qualify them for the duties of citizens of a republic. Its members shall therefore obtain, in the meetings of the association, a knowledge of our laws and political economy, and shall also be instructed in military and gymnastic exercises;" that Presser, in December, 1879, marched at the head of said company, about four hundred in number, in the streets of the city (p.255) of Chicago, he riding on horseback and in command; that the company was armed with rifles and Presser with a cavalry sword; that the company had no license from the governor of Illinois to drill or parade as a part of the militia of the State, and was not a part of the regular organized militia of the State, nor a part of troops of the United States, and had no organization under the militia law of the United States. The evidence showed no other facts. Exceptions were reserved to the ruling of the court upon the motion to quash the indictment, to the finding of guilty, and to the judgment thereon. The case was taken to the Supreme Court of Illinois, where the judgment was affirmed. Thereupon Presser brought the present writ of error for a review of the judgment of affirmance.

I knew where this case was going when the court cited these three things:

Presser was:

1) A citizen of the United States and of the State of Illinois (noted 14th Amendment citizenship, he is a legal entity thus controlled by the state);
2) A voter (he is in rebellion against his lawful government);
3) And belonged to a society incorporated under Revised Statutes of Illinois (a creature of the state, thus controlled by its creator).

One, Two, Three, he's out!

No natural or "original" constitutional rights, as he (Presser) was a creature of the State both in his person and being a member of an incorporation.
The 2nd Amendment did not apply to him: Arguing it was worthless.

The 2nd Amendment only applies to men. People have been turned into legal entities by the 14th Amendment and therefore controlled by the state.
The sooner people understand this, the sooner we get the states back from these usurping insurgents.

Learn more here [link to www.pacinlaw.org]

p.s. The purpose of the 2nd Amendment in the original context of the constitutional system was to protect the states from the government in regard to the militia. The amendment has nothing to do with one's NATURAL right to own a gun in his defense, and his country. The NRA is a fraud. Its job is to keep people confused under this system under the 14th Amendment, a.k.a. planned opposed resistance.

And hey, do not forget that Americans think the government is their god.
They think the 2nd Amendment gives them the right to own a gun.

See how dumb-down they are:

I could be wrong, but I think that bird is an Osprey. OT, but your eagle story reminded me of a day last summer when a bald eagle with a giant fish (looked like it was 2-3 foot long) touched down in my backyard for his meal. I live near a bird sanctuary, but I'd never seen an eagle up close like that before. They're HUGE, with big stocky legs. He tore that poor fish apart in no time flat. Wish I'd had a video camera.

It may come to this in all states that want to retain 2nd Amendment rights, or other rights, or maybe any...

[link to www.montanasnewsstation.com]

Firearms manufactured and used in Montana would become exempt from federal regulation under a bill being considered in the Montana House.

The State House voted in favor of House Bill 246 in second reading on Saturday, and the bill could have the effect of releasing Montana gun owners from federal registration requirements.

The measure applies to firearms, firearm accessories and ammunition that are made and sold in the state.
The bill's sponsor says his proposal is more about states' rights than about gun rights.
