This bill is sitting in committee and I am not sure when it is going to hit the floor. One thing I do know is that very few of the Representatives have read it.

As usual they will vote on this based on what someone else is saying. Urge your members to read the legislation and ask for opposition to this devastating legislation.

Devastating for everyday folks but great for factory farming ops like Monsanto, ADM, Sodexo and Tyson to name a few.


I have no doubt that this legislation was heavily influenced by lobbyists from huge food producers.

This legislation is so broad based that technically someone with a little backyard garden could get fined and have their property siezed.


It will effect anyone who produces food even if they do not sell but only consume it. It will literally put all independent farmers and food producers out of business due to the huge amounts of money it will take to conform to factory farming methods.

If people choose to farm without industry standards such as chemical pesticides and fertilizers they will be subject to a vareity of harassment from this completely new agency that has never before existed.


That's right, a whole new government agency is being created just to police food, for our own protection of course.


DO NOT TAKE MY WORD FOR IT, READ THIS LEGISLATION FOR YOURSELF. The more people who read this legislation the more insight we are going to get and be able to share.


Post your observations and insights below. Urge your members to read this legislation and to oppose the passage of this legislation.

Pay special attention to

Section 3 which is the definitions portion of the bill-read in it's entirety.

section 103, 206 and 207- read in it's entirety.
Red flags I found and I am sure there are more...........

Legally binds state agriculture depts to enforcing federal guidelines effectively taking away the states power to do anything other than being food police for the federal dept.
Effectively criminalizes organic farming but doesn't actually use the word organic.

Effects anyone growing food even if they are not selling it but consuming it.

Effects anyone producing meat of any kind including wild game.

Legislation is so broad based that every aspect of growing or producing food can be made illegal. There are no specifics which is bizarre considering how long the legislation is.


Section 103 is almost entirely about the administrative aspect of the legislation. It will allow the appointing of officials from the factory farming corporations and lobbyists and classify them as experts and allow them to determine and interpret the legislation. Who do you think they are going to side with?


Section 206 defines what will be considered a food production facility and what will be enforced up all food production facilities. The wording is so broad based that a backyard gardener could be fined and more.


Section 207 requires that the state's agriculture dept act as the food police and enforce the federal requirements. This takes away the states power and is in violation of the 10th amendment.

There are many more but by the time I got this far in the legislation I was so alarmed that I wanted to bring someone's attention to it. (to the one person who reads my blog)


Didn't Stalin nationalize farming methods that enabled his administration to gain control over the food supply?

Didn't Stalin use the food to control the people?



Last word...... Legislate religion and enforce gag orders on ministers on what can and can't be said in the pulpit, instituting regulations forcing people to rely soley on the government, control the money and the food.

What is that called? It is on the tip of my tongue..........


I haven't read any of the Senate's version of the bill as I have been poring thru the House's version.

Here is the link and I hope some of you can take a look and post your observations and insights below.

One thing I am pretty sure of is that very few if any Senator's have actually read the legislation and when it comes up for a vote they will more than likely take someone else's word on how they should vote.

The other thing I am pretty sure about is that the legislation was probably written by lobbyists and
industry experts.

Contact your members at

202-224-3121 and ask them to oppose HR 875 and S 425.



While you are at it ask them if they personally have read the legislation and what their position is?

If they have not read the legislation ask them to read it and politely let them know that just because other representitives are not reading the legislation and voting on it does not mean they can do the same.


Get in touch with local farmers and food producers by attending a local farmers market and asking them how business is.


Attend a local WAPF meeting, this is a good start to learning about what is going on in farming and local
& state initiatives .

You said something to the effect on the Rev's thread about the flu coming now or maybe next flu season etc but be prepared. ( Meaning now or later coming) Well if later next flu season with this new law for gardens and Codex coming Dec 2009 you will no longer be able to get many supplements and vitamins at all or some above certain doses without a Dr. Prescription.

Anyway this is important to not let get through being able to grow your own food etc is important!!

Have read both bills, and the House Bill is really unbelievable, it should be defeated just for it's creation of a new, massive agency to take the place of the food part of the FDA. It's an insane idea that should be shot down. I heard these were coming up soon, so call your reps AND the sponsors of the bill (listed on front page). The House Bill is so broad it could include your garden...it also says "every vineyard and orchard" would be considered a "food production" facility. WTF? Nothing is defined well except, of course, penalties. 1 million per infraction, and each day the infraction continues is considered a new infraction. CRIMINAL.

These bills coupled with the fact that the draconian limits on water consumption in California (NO irrigation water to thousands of people) just leads me to believe that TPTB think they have their 'ducks in a row' to bring about this 'One World Socialism' up and online.

A pandemic will just escalate it's implementation.

Truly perilous days ahead.

Here's the section on FOOD CONTROL:

Food supplies would come under tight control. If population growth didn't slow down, food shortages could be created in a hurry and people would realize the dangers of overpopulation.

Ultimately, whether the population slows down or not the food supply is to be brought under centralized control so that people would have enough to be well-nourished but they would not have enough to support any fugitive from the new system. In other words, if you had a friend or relative who didn't sign on, and growing ones own food would be outlawed.

This would be done under some sort of pretext. In the beginning I mentioned there were two purposes for everything - one the ostensible purpose and one the real purpose, and the ostensible purpose here would be that growing your own vegetables was unsafe, it would spread disease or something like that. So the acceptable idea was to protect the consumer but the real idea was to limit the food supply and growing your own food would be illegal. And if you persist in illegal activities like growing your own food, then you're a criminal.

Requirements to be called an Organic Farmer

Here are some Synthetic substances allowed for use in organic crop production.

In accordance with restrictions specified in this section, the following synthetic substances may
be used in organic crop production: Provided, That, use of such substances do not contribute to
contamination of crops, soil, or water. Substances allowed by this section, except disinfectants
and sanitizers in paragraph (a) and those substances in paragraphs (c), (j), (k), and (l) of this

section, may only be used when the provisions set forth in §205.206(a) through (d) prove
insufficient to prevent or control the target pest.
(a) As algicide, disinfectants, and sanitizer, including irrigation system cleaning systems.
(1) Alcohols.
(i) Ethanol.
(ii) Isopropanol.
(2) Chlorine materials— Except, That, residual chlorine levels in the water shall not exceed the
maximum residual disinfectant limit under the Safe Drinking Water Act.
(i) Calcium hypochlorite.
(ii) Chlorine dioxide.
(iii) Sodium hypochlorite.
(3) Copper sulfate—for use as an algicide in aquatic rice systems, is limited to one application
per field during any 24-month period. Application rates are limited to those which do not
increase baseline soil test values for copper over a timeframe agreed upon by the producer and
accredited certifying agent.
(4) Hydrogen peroxide.
(5) Ozone gas—for use as an irrigation system cleaner only.
(6) Peracetic acid—for use in disinfecting equipment, seed, and asexually propagated planting
material.
(7) Soap-based algicide/demossers.
(b) As herbicides, weed barriers, as applicable.
(1) Herbicides, soap-based—for use in farmstead maintenance (roadways, ditches, right of ways,
building perimeters) and ornamental crops.
(2) Mulches.
(i) Newspaper or other recycled paper, without glossy or colored inks.
(ii) Plastic mulch and covers (petroleum-based other than polyvinyl chloride (PVC)).
(c) As compost feedstocks—Newspapers or other recycled paper, without glossy or colored inks.

(d) As animal repellents—Soaps, ammonium—for use as a large animal repellant only, no
contact with soil or edible portion of crop.
(e) As insecticides (including acaricides or mite control).
(1) Ammonium carbonate—for use as bait in insect traps only, no direct contact with crop or

(2) Boric acid—structural pest control, no direct contact with organic food or crops.
(3) Copper sulfate—for use as tadpole shrimp control in aquatic rice production, is limited to one

(4) Elemental sulfur.

nitrates or chlorides are not allowed. Soil deficiency must be documented by testing.
(i) Soluble boron products.
(ii) Sulfates, carbonates, oxides, or silicates of zinc, copper, iron, manganese, molybdenum,
selenium, and cobalt.
(7) Liquid fish products—can be pH adjusted with sulfuric, citric or phosphoric acid. The
amount of acid used shall not exceed the minimum needed to lower the pH to 3.5.
(8) Vitamins, B1, C, and E.
(k) As plant growth regulators. Ethylene gas—for regulation of pineapple flowering.

(l) As floating agents in postharvest handling.
(1) Lignin sulfonate.
(2) Sodium silicate—for tree fruit and fiber processing.
(m) As synthetic inert ingredients as classified by the Environmental Protection Agency (EPA),
for use with nonsynthetic substances or synthetic substances listed in this section and used as an
active pesticide ingredient in accordance with any limitations on the use of such substances.
(1) EPA List 4—Inerts of Minimal Concern.
(2) EPA List 3—Inerts of Unknown Toxicity allowed:
(i) Glycerine Oleate (Glycerol monooleate) (CAS #s 37220–82–9)—for use only until December
31, 2006.
(ii) Inerts used in passive pheromone dispensers.
(n) Seed preparations. Hydrogen chloride (CAS # 7647–01–0)—for delinting cotton seed for
planting.

treat a physiological disorder associated with calcium uptake.
(d) Lead salts.
(e) Potassium chloride—unless derived from a mined source and applied in a manner that
minimizes chloride accumulation in the soil.

(g) Sodium nitrate—unless use is restricted to no more than 20% of the crop's total nitrogen
requirement; use in spirulina production is unrestricted until October 21, 2005.

§ 205.603 Synthetic substances allowed for use in organic livestock production.
In accordance with restrictions specified in this section the following synthetic substances may
be used in organic livestock production:
(a) As disinfectants, sanitizer, and medical treatments as applicable.
(1) Alcohols.
(i) Ethanol-disinfectant and sanitizer only, prohibited as a feed additive.
(ii) Isopropanol-disinfectant only.
(2) Aspirin-approved for health care use to reduce inflammation.
(3) Atropine (CAS #–51–55–8)—federal law restricts this drug to use by or on the lawful written
or oral order of a licensed veterinarian, in full compliance with the AMDUCA and 21 CFR part
530 of the Food and Drug Administration regulations. Also, for use under 7 CFR Part 205, the
NOP requires:
(i) Use by or on the lawful written order of a licensed veterinarian; and
(ii) A meat withdrawal period of at least 56 days after administering to livestock intended for
slaughter; and a milk discard period of at least 12 days after administering to dairy animals.
(4) Biologics—Vaccines.
(5) Butorphanol (CAS #–42408–82–2)—federal law restricts this drug to use by or on the lawful
written or oral order of a licensed veterinarian, in full compliance with the AMDUCA and 21
CFR part 530 of the Food and Drug Administration regulations. Also, for use under 7 CFR Part
205, the NOP requires:
(i) Use by or on the lawful written order of a licensed veterinarian; and
(ii) A meat withdrawal period of at least 42 days after administering to livestock intended for
slaughter; and a milk discard period of at least 8 days after administering to dairy animals.

(6) Chlorhexidine—Allowed for surgical procedures conducted by a veterinarian. Allowed for
use as a teat dip when alternative germicidal agents and/or physical barriers have lost their
effectiveness.
(7) Chlorine materials—disinfecting and sanitizing facilities and equipment. Residual chlorine
levels in the water shall not exceed the maximum residual disinfectant limit under the Safe
Drinking Water Act.
(i) Calcium hypochlorite.
(ii) Chlorine dioxide.
(iii) Sodium hypochlorite.
(8) Electrolytes—without antibiotics.
(9) Flunixin (CAS #–38677–85–9)—in accordance with approved labeling; except that for use
under 7 CFR Part 205, the NOP requires a withdrawal period of at least two-times that required
by the FDA.
(10) Furosemide (CAS #–54–31–9)—in accordance with approved labeling; except that for use
under 7 CFR Part 205, the NOP requires a withdrawal period of at least two-times that required
that required by the FDA.
(11) Glucose.
(12) Glycerine—Allowed as a livestock teat dip, must be produced through the hydrolysis of fats
or oils.
(13) Hydrogen peroxide.
(14) Iodine.
(15) Magnesium hydroxide (CAS #–1309–42–8)—federal law restricts this drug to use by or on
the lawful written or oral order of a licensed veterinarian, in full compliance with the AMDUCA
and 21 CFR part 530 of the Food and Drug Administration regulations. Also, for use under 7
CFR part 205, the NOP requires use by or on the lawful written order of a licensed veterinarian.
(16) Magnesium sulfate.

This isn't surprising since there is a city not far from where I live that passed an ordinance banning garden plots larger than 50 square feet (that would be 1 row 25 ft long and 2 ft wide)inside the city limits.
The "logic" behind this is that people would be forced to buy fruits and veggies at the local markets thus putting money back into the economy and community.
Oh and that lone apple tree in your backyard that produces fruit counts as 5 sq ft of your allotted 50.

Right now i got about 20 seedlings waiting for warm weather under fluresence and too many pots in windows.

I don't understand anyone at any time discouraging anyone from gardening, gardening is the #1 hobby in the nation and a HUGE industry that employs many people.

But especially now, with the economic news being what it is, the government at all levels should be pushing Victory-style gardens for everyone, for health reasons, for education, for therapeutic reasons, for beautification, for production, for everything. For the glory of God, if it's not subversive to say so.
