I filed for chapter 13 in jan 08. The reason being is that I hadnt paid my taxes for 8 years.
Of course the IRS caught up to me and I had to go back and file each years return. The principle was around 15000 but with late fees and penalties it grew to around 50000.
The IRS wanted around 700 a month but the interest would still be rolling....In the chap 13 interst stops acrueing.
Trouble is in a BK they take all "disposable income" They wanted 960 month.

I did it for almost a year but I have missed two payments and just like the guy in office spaces Im like.. I dont want to pay anymore.
I work in a restaurant job and sales are down 20% which means my pay is alot less than in previous years and I dont think its going to get better...rather its going to get worse.

Anyone here ever have to deal with a BK or get out of a chap 13? I cannot do a chap 7 because of Bush and I make over 45000 a year.

The only creditor of importance is the IRS, the others were under 2000 dollar credit cards...so they wont bother filing suit especially in the times we are in.

File a motion to dismiss your bankruptcy.. Then contact an agency that works with the IRS. They have many people out there helping - and they can even reduce the fees.

To get out of Chapter 13 you can just quit paying as you have done. bad thing is IRS penalties restart and go back for the near year you paid. They will come knocking again( the IRS)

A Chapter 7 will only remove old taxes in certain circumstances.

You can re-enter Chapter 13

But you are in for a Tough road ahead

IF you stop paying the trustee will dismiss your BK13. Don't let that happen. They can then bar you for 6 months to file again. And that will even look worse if the Trustee dismisses your case for non-payment.

Make sure you dismiss it yourself!
