Jim Persey on the phone talking her through it! The bank sold the loan and the 2nd bank did not file correctly. The owner resident has them on a technicality the first bank said her loan was paid in full via written letter the 2nd bank was not listed at all. The second bank went back and proceeded to file etc and start foreclosure proceedings. This will be touch and go. She needs a good lawyer for what good that will do. Banks have a slew of lawyers to deal with just this kind of stuff. It was their error not hers they need to deal with it not her. She's looking out the window, and they have the pepper spray ready, but they were told that the folks inside the home have cameras! They are looking for a way to get into her home! It was happening in Missouri. They tape recorded as the sheriff came and broke the door and came in and arrested her. Joyce said it was about five minutes. It should be on the :08 of the next hour. Bank failed. Apparently bank error not in your favor. Don't they have to give you a set time before you are arrested. Like, they serve you with a foreclosure notice and you have thirty days or something like that. |

The bank has an incentive to foreclose, because it can sell the property and still make a killing. If you had a mortgage for 300k on a home that's now worth 150k, and you foreclose, the bank has to write off 150k somehow after it sells the home. This is insane. |

We do know that she has already gone to court about this and that they did say she owes even though she does have the proper paper work to prove otherwise. In a case such as this it should be illegal for law enforcement to bust down your door since it was a mistake between the financial institutions. They need to investigate the bank that marked that property as paid before busting down someones door, taking there property and arresting them. If what we know so far is true, this lady should not owe one cent. The bank that screwed up should eat it. Also if what we already know is true, the bank that carried this out should pay the damages caused by such a hurrendous mistake. So far it smells more like total incompetence if not criminal on the part of the financial institutions and judicial system involved. Lets see what happens. Eventually the truth will prevail. Also this story is worth following, dont ya think? It may be you that is next on there list of errors. |

This is insane. listen to the radio show... she says she re-fi'd for 135k a couple years ago... she thought she "got over" when the bank sent that "your balance is 0" letter.... kinda bit her in the ass, eh? a notice that you no longer owe a particular lender isnt the same as "i own it free and clear".... |
