criminals will not even discuss thier crimes with relatives or best friends.at any time ..so cases are thrown out . cops bug relativ es and friends homes even thier work places and cars and bars and all hangouts jails and everyones phones and still gained no evidence . ..so career criminal gets another free "get out of jail" card . but other evidence puts the killer at the scene of the crime..so no get out of jail card now. . .

Yes I hear you I typically would not ask that unless a certain period of time had elapsed, maybe 10-15 minutes, as it still plants a negative connotation in their tiny little minds.

You should be aware of another trick that is used. If you are present at the police station voluntarily and are not under arrest and the Miranda protections do not apply. You may be asked to "come down to the station and talk to us to clear something up." You show up and talk to them. You were never Mirandized and free to leave any time. Therefore, none of your statements can be suppressed for failure to give you a Miranda warning. On the other hand, if they tell you that you are not free to go and do not Mirandize you then any confession or admission is not admissible in court.

Good point. Example of a slightly different approach. Homeowner shoots a burglar. 1st car on the scene is gonna get an earful. The detctives are then gonna make a point of NOT Mirandizing the guy for protecting the family until something looks wrong and it turns out that this is a drug buddy who comes over regularly or some shit like that. I can't fathom cops who would want to jam up a citizen for capping a threat to him or his house. IT JUST AIN'T DONE IN DIXIE>...pretty much. Bottom line...if you think you MAY have fucked up....exercise your rights..I have and will again if it comes up. Once brass and politwhores get involved you never know what will go down. Seriously I want y'all to be armed and well so. I may bed you to shoot some shithead off'n me some day...Aim High!

Yeah, I think it's out of control.

Here's something that recently happened to me.

I am a single Mom to a 17 year old son who tends to get into mischief regularly. So, I go out for the first time in months to have some fun with my friends, my son was at work until 9.30. I get home around 11.30 and when I pull up to my apartment there is a police car in front of my building. Evidently while I was gone 3 of my sons friends had come over (without my permission), were being rowdy and 2 under cover cops who 'happened' to be in the area were in my place questioning them (they are all minors). I go to the door, they wouldn't let me in my own apartment, I told them to send my son outside to me.

Finally I go in. They charge two of the boys with possession of less than an ounce. So, I'm standing there talking to the police officer (at this point there are three in my house), when the fucking SWAT Team shows up. SEVEN, no shit SEVEN of them file into my 2 BR apartment. I look at all of them as they are milling around my small apartment and say, 'Boys don't ya think this is a bit of over kill?' ...

Then my son starts to talk - begins to tell them in detail everything that had happened. Before he could finish the first sentence I looked at him and said 'Shut Up' .... he kept talking, and I said 'Shut the fuck up now, you don't say another word'. One of the police officers turned to my son and said, Son, how old are you, he said 17, the cop said, listen to your Mother.

Then I reminded them all that they were all in my home, they did not have a warrant or any problem with me or my son and I wanted them to leave my home. They left.

So what the fuck can you do in the case of a pastor when a dog walks around your vehicle, nothing happens, and they "claim" he detected something which is just bullshit? You can't do shit? You have to exit your vehicle??


Let them do their investigate unhindered.

Then put the dog on the stand at trial if they find anything and insist to cross examine the dog.

Ask the dog if he was sure he smelled weed or was it really a ham sammwich

I'm talking about legit situations where there is nothing to be found, but I get your point. Pretty much you're forced to exit the vehicle and they can search it regardless of whether or not the dog indicates anything, because they can just "claim" he did.

One time I was walking down the road and a cop car pulled up to me and asked me my name and where I lived. I said "with a due respect officer, I do not want to talk to you" and I kept walking as he had the strangest look on his face.

SO I get up a little further down the road and another cop from the same town pulls over and asked me my name and where I live. Once again I told him that I did not want to speak to him.

So now this cop gets pretty pissed off and jumps out of his car and demands that I put my hands on the hood of the patraoll car.

I ask him if I am being arrested or detained. He says "No".

So I say, "See you later"

As I start walking he grabs me and says "now you are being detained" I said "For what"?

"For not telling me your name and where you live"

I said, "What is this NAzi Germany"....

Then he let me go.. and as I was walking away... he said "YOur not right"!!!!

Yeahh... ok.

This is your first error.

You say, "Take your hands off me or I'll charge you with ASSAULT".

Why do you say this?

Because he has no authority over you, whatsoever. He cannot touch you legally. He cannot move you without being charged with kidnapping, he cannot take you to jail without being charged with unlawful imprisonment, etc, etc. A cop is not a Policeman nor a Officer. He is a "code enforcer".

First word out of his mouth and you can TELL HIM, "I want a Lawyer". As soon as you say that, he by law, must stop asking you anything. if he continues, and he will, tell him, "Im going to tell my Lawyer everything you say and do from this moment on". That should either stop him dead or get you roughed up. If he roughs you up you can recover all damages.

You can ask, "What code am I not keeping".

You can ask, "Am I under arrest".

You can ask, "Who are you?".

You can ask, "What is your name, badge number, Identification because you could be some thug in a uniform". This happens to be exactly what he is.

I have caught guys like this walikng down the road and he can stop you he can question you IF there have been a a rash of burglaries of cars, car thefts or you in or near an area known for drug sales, The thing is is it that big a deal to say hey I'm Bob and I'm walking home from work, or Grandma's or hatever. Like going thru the green light when you can see the other guy isn't gonna stop on his side which is red. He kills you but you were right. I found a guy oner New Years Eve walking down an isolated spot. He said he had been ata fiend house drinking and whewn the friends wife started flirting with him being drunk too he decided to leave....didn't want to drive so he was walking. I took him home...also IF I had had any burglaries . UBEV or thefts in that area I would have had at least one possible suspect to look at. If it wasn't him I would not worry about him anymore. Think People. Sorry for the typos The sugar from the donuts makes my fingers sticky. LOL That was GOOD BOOK TOO!

Watch the show cops. Notice how the idiot cops tell the camera man: "we're in an area/aprtment complex/neighborhood known for illegal narcotics activity". "That car doesnt look like it's from around here so I'm gonna (ILLEGALLY) pull them over". Now, if the dum ass dope fiends had read this thread they'd say nothing to the cop. When the cop says "I saw you come out of nI_gga central project back there what are you doing in there?"

say nothing but "here's my license, registration and proof of insurance". You have all that right? Don't you think getting insirance and yer license is cheaper than bail, attorneys, lost wages and the hassle of jail? Yes. It is. Alot cheaper as a matter of fact.. If you look and sound like you can defend yourself, intelectually and financially cops are gonnna look for easier prey. They are predators, and predators are universally cowardly. They always go after the weak.

Here's a couple real world incidents I've experienced:

Late one summer friday afternoon in California, I'm traveling home after leaving a stupid Corporate meeting that went on til after 5 o'clock, during heavy rush hour traffic (this was before the depression started a couple years ago when there was still alot of traffic on friday afternoons). CHP pulls me over, even though I am one of the few people doing the speed limit, minding my own business, not passing on the right on onramps like alot maniacs do. Just cruising in my new Dodge diesel truck. Anyway, a little hispanic rookie, shaped like a fireplug, suffering from "little mejican" syndrome I guess. Pulls me over. Tells me he pulled me over for not wearing my seatbelt. I tell him that I am exempt from the seatbelt law.CA Vehicle code 27315.3a defines vehicles subject to the the unconstitutional seatbelt law (aka we need more excuses to pull people over law). In that section it says the law applys to "motortruck up to 6001 lbs unladen". Motortruck is what the CA vehicle code calls pickup trucks. Anyway, he then says, "How much have you had to drink this afternoon" I tell him, "Oh about a six pack, of EVIAN". He says "sit tight" and goes back to his car. As I'm monitoring CHP mobile extender freqs. on my scanner at all times, I hear him call back for backup for a "beligerant subject". He then comes back to the window and says "mind if i have a look around in the car?" I say "Sure as long as the Sargeant pulling up behind there has a warrant". He goes back to the Sarge that pulled up and the sarge comes up to the window. "What's the problem? "I have no problem Sargeant, senor Rodriguez however does. "Apparently he's not aware of vehicle code or the 4th amendment to the constitution" By no FirePlug rodriguez is about to pop a vein, I know he wants to arrest me and fuck me up. I remain cool. "What, are you some kind of attorney?" If you do answer cops questions, it's best to answer them with questions so I say "Why do you ask, would it change your behaviour if i was?" Sarge chuckles, fireplug visibly restrains himself. Sarge tells him to write me for the 27315. He does, I sign and say "see ya in court"

So I take it to court. Coulda paid the $22.00 fine, but fuck that, I'm right and i know it. I had recently convinced another CHP in Alpine COunty CA (WAAAy up in the mountains) that 27315.3 exempted heavy pickups with commercial plates, he told me at the time that that "was true" but that the legislature had changed it to include heavy trucks. He did not write me a ticket.
Anyway, I plead not guilty and get a court date. Court date comes around, I show up on time. The bailiff gets up there and says, those of you here for trial come out in the lobby, I have info for you. We go out there, about 7-8 people fighting tickets. Bailiff says "we need you to sign off and accept temporary judge. we're very busy, so we have a temp judge sworn in to hear your case. He's an attorney and is acting as a real jusge". Sign here to accept. WTF? I say, just like this "Fuck that I want a real judge, and I think everyone here should demand their right to a trial heard by a sitting judge" Bailif starts tellin me I'm in contempt of court and he makes move like he's gonna put hands on me. I say "BULLSHIT" contempt of court for foul language can onlly be charged INSIDE the court or in case of a gag order, we ARE not in the court, therefore we are NOT subject to contempt of court for profanity out HERE IN THE LOBBY!" Lotta people watchin us now. Other deputies start comin over hearing the loud altercation. I proceed to tell the other people fighting their tickets to NOT accept a "fake" judge. I KNOW why they're doin' this- they don't have a judge available. In spite of my attempts to win all 8 over only two others demand a "real" judge. Still, the bailiff is flustered. he tells us to go back in and be seated. He goes the the judge. Mind you there are over a hundred people and about a dozen cops in the courtroom. After talking to the judge, the bailiff tells us that the two refusing the temp judge must go up to another court upstairs. We go. I sit sit down, in an almost empty court, just the family members of some tweaker who's pre-trial hearing was in progress. Bailiff has to INTERUPT! goes up to the judge and whispers to here, then jesturing at ME. She look PISSED!. She has to recess the tweaker, to hear my $22.00 seatbelt ticket!

So the cop gets up there to the new court room, she calls him up, he does his usual bit of cop lieing. "I was westbound, saw mr B here in the number 4 lane not wearing his seatbelt, I could see the metal flash of the seatbelt buckle glinting in the sun, thats how I could tell from 400 feet away that he wasnt using it." Blah blah blah. Mr b stated that he was exempt from the seatbelt law, but your honor it's the CHP's interpetation that there ARE NO exemptions to the seatbelt law"

Judge's eyebrow goes up, "Officer, since when was the CHP empowered to INTERPET the law as opposed to enforce it?" Cops starts sputtering about semantics, decision making processes and othe incherent cop babble.

My turn!

Your honor, the officer shows blatant ignorance of the law in this case. for indeed the CA vehicle code has MANY exemptions to the seatbelt law. In fact, as a LEO, he should know that POLICE are exempt from the seat belt law. There are many other exemptions too! Limosuines, school buses, RV's! TAXI's! OLD CARS never built with seatbelts! AND the exemption that I'm claiming, "MOTORTRUCKS EXCEEDING 6001 lbs UNLADEN". I hand the bailiff my printout from the CA.gov veh. code site and my registration with the current weight fees for a commercial tagged truck with unladen weight 6026lbs!. She looks at it. Then asks for a current vehicle code book be sent up. Silence. we wait. Cops starts to popoff about how the seat belt law is universal now, she tells him to STFU. He stews. He stares at me. We wait. Been there at least an hour now. She finally gets the code book. She starts readin it. She's thumbing back and fourth between several sections for what seemed like 15 minutes. She finally asks me "How many passengers can your vehicle legally seat?" I tell her "6". She say's "What is the primary purpose for which you use this vehicle?" I say "hauling stuff, sometimes across state lines" (I'm thinking I throw interstate commerce in there cuz there really lookin fer a reason NOT to dismiss this. Now, they're ALL pissed at me.

She finally says "DISMISSED get out of here!" Cop sighs very loud. On the way out the doors the cop tells me "I don't care what she said, If I see you with no seatbelt I'm pullin you over" I tell him "well, suit yerself ASSHOLE, but listen, I'm goin right out there in the parking lot, I have the same truck as last time an I'm NOT gonna wear my seatbelt you DO what you gotta DO". I really thought he was gonna bump me again but he left me alone!

tomorrow I'll post how i handled and WON my FOURTH seatbelt ticket trial in Lincoln, CA.

And how I lost my case for my THIRD seatbelt ticket at trial. (subsequently won on written appeal)

Only thing I would add is I dunno bout your State, in Texas, at least the traffic court I went to did not have a stenographer present. ALWAYS INSIST on one, it's your right and a judge is much more likely to be careful when one is present for obvious reasons, even though you won that one. Congrats!!!

As once you have done this you have changed the game and depending upon what you have done or not done many of them will then determine the next course of action based upon your demeanor.

I can tell you that i have had friends jaws drop as I got back in the car and continued on our merry way. Dont be an ass and worse is dont be a laydown.

The bottom line to them is paperwork and convictions so if you give them a reason to start the first they often dont care about the second.

BTW, I have no fucking idea if I'm correct about being exempt from contempt of court for foul language in the lobby But I made it sound like I was at the time! (I think that's the case, but I'm not absolutely sure, so YMMV!

+1 on the gettin out of the car. You guys seen the ACLU video about how to handle a stop? If you get out of the car and shut the door and LOCK it, cops can't use the bullshit "I smell weed" therfore I have PC to search routine. If yer dealin with Texas cops who ROUTINELY commit felonies, this may not work, but if yer in a more civilized, lawyered up (ie affluent) area, it prolly will help.

Bwhahahahahaahah here's a story. Remember Tia? I was driving Tia from North Texas to the ranch in Lampassas by myself and this poduck punk ass cop decided to pull me over for speeding in PDB's Toyota 4 runner. Tia was in the back and was layin low.

Cop asks me for my SS #. I told him I am not compelled at law to provide it. He got snippy and says can I look in the back of the vehicle. I ask why? He says do I have any contraband> I say no. He wants to look anyway. He is insistent.

I say sure man go ahead.

Omega reaches up and adjusts the rear view mirror accordingly. Heh.


Punk cop opens the back lid of the 4 runner and gets Tia coming off the carpet very pissed off and in his face.....

Cop starts backing up wildly pawing for his pistol didn't even get the restraining strap off. He didn't fall on his ass but he came damn close.

I laughed like a mutherfucker.

He was pissed but what could he do??? He gave me the ticket and I split.


I laughed for fucking hours. I laugh to this day. I wonder if dude had to change his shorts.

Hand it to them and wait, some of them will try to stop you from getting out of the car, however there is no law that says you have to say in it just with it.
