Yeah, I think it's out of control.

Here's something that recently happened to me.

I am a single Mom to a 17 year old son who tends to get into mischief regularly. So, I go out for the first time in months to have some fun with my friends, my son was at work until 9.30. I get home around 11.30 and when I pull up to my apartment there is a police car in front of my building. Evidently while I was gone 3 of my sons friends had come over (without my permission), were being rowdy and 2 under cover cops who 'happened' to be in the area were in my place questioning them (they are all minors). I go to the door, they wouldn't let me in my own apartment, I told them to send my son outside to me.

Finally I go in. They charge two of the boys with possession of less than an ounce. So, I'm standing there talking to the police officer (at this point there are three in my house), when the fucking SWAT Team shows up. SEVEN, no shit SEVEN of them file into my 2 BR apartment. I look at all of them as they are milling around my small apartment and say, 'Boys don't ya think this is a bit of over kill?' ...

Then my son starts to talk - begins to tell them in detail everything that had happened. Before he could finish the first sentence I looked at him and said 'Shut Up' .... he kept talking, and I said 'Shut the fuck up now, you don't say another word'. One of the police officers turned to my son and said, Son, how old are you, he said 17, the cop said, listen to your Mother.

Then I reminded them all that they were all in my home, they did not have a warrant or any problem with me or my son and I wanted them to leave my home. They left.

I would say make sure they take a second sample that your attorney can get to an independent lab because the police labs are notoriously inaccurate on the side of conviction. I once saw the stats for our state lab and it didn't look normal bell curve at all but had a big lump just over the legal limit. If you can get them to use an alcohol swab then that can be grounds to get the test thrown out due to contamination but they'd have to be pretty dumb for that. The longer you can delay the sample the better as your body removes alcohol at a certain rate. Also keep in mind that blood alcohol is only prima facie evidence meaning the burden of proof shifts to the defendant for impairment although you will get your license yanked but that is administrative separate from the criminal court proceeding. Heed the advice - say nothing and get a good lawyer. In large cities they have law firms that specialize in drunk driving defense and if you are say a pilot that would loose your ability to work if you were convicted its essential that you employee such firms. They will do a top to bottwm look at the calibration of the machine, the software, its maintenance history and hire expert witnesses to testify as to the inaccuracy of testing and their investigator will visit the scene and have you re-enact the stop but it will cost a lot and will be tried before a jury. In my state its 2 days mandatory jail first, 5 for second, 90 for third and I believe they just passed 180 days mandatory for third offense. You can get a diversion on your first one if you didn't hurt anyone. That means the charges are dismissed if you stay clean for a year but it will still count as a first offense so if you get caught again that will be a second even if you had diversion. DUIs cannot be plea bargained here.

Thanks. Most people feel they are compelled to volunteer information to the police. You are not. Don't do it. Ever. They will try to use punk tactics to trip you up and use any information they glean against you. . They will even try and befriend you. The police are not your friends.

One time I was pulled over for speeding (there was a time in my life when every time I was stopped it was a felony stop but that's a different story) the cop says step over here son-right in front of his cop car camera.

He starts asking me questions like have you been drinking? (I had not).

I said lemme get this straight you want me to testify against myself in front of your police camera?

Bwhahahaahahaahaha. laughed in his face.

He was not amused. Tough shit.

That's all I said produced the id and insurance.

Man there are some great replies from police on this thread......thanks all.....

BTW folks I know some local Sheriffs that are cool....my experience is the older crowd (lets say 35-40 and over) are typically old school and reasonable......than again I am out in the sticks YMMV......

AS a last resort, if yer on the knife edge of getting arrested or not. Shit your pants. You heard me right shit your pants! And BARF too if you can. This ploy only works if you do it BEFORE he puts you in the car. Shit and barf, the more stink the better. Make sure he knows his car is gonna stink to high heaven if he puts you in there.

No cop is gonna put a shitter in their car unless they absolutey HAVE to.

Believe me. It works.

One time I was walking down the road and a cop car pulled up to me and asked me my name and where I lived. I said "with a due respect officer, I do not want to talk to you" and I kept walking as he had the strangest look on his face.

SO I get up a little further down the road and another cop from the same town pulls over and asked me my name and where I live. Once again I told him that I did not want to speak to him.

So now this cop gets pretty pissed off and jumps out of his car and demands that I put my hands on the hood of the patraoll car.

I ask him if I am being arrested or detained. He says "No".

So I say, "See you later"

As I start walking he grabs me and says "now you are being detained" I said "For what"?

"For not telling me your name and where you live"

I said, "What is this NAzi Germany"....

Then he let me go.. and as I was walking away... he said "YOur not right"!!!!

First word out of his mouth and you can TELL HIM, "I want a Lawyer". As soon as you say that, he by law, must stop asking you anything. if he continues, and he will, tell him, "Im going to tell my Lawyer everything you say and do from this moment on". That should either stop him dead or get you roughed up. If he roughs you up you can recover all damages.

You can ask, "What code am I not keeping".

You can ask, "Am I under arrest".

You can ask, "Who are you?".

You can ask, "What is your name, badge number, Identification because you could be some thug in a uniform". This happens to be exactly what he is.

Always a good idea,

especially when drunk,

ESPECIALLY when drunk driving.

I got a DUI 9 years ago. I gave them only the info that was on my Drivers License, and refused any sobriety tests. That resulted in an automatic 1 year license suspension. Other than that, I got off easier than anyone else that was in court on the same day as I was, and I was able to get my work permit drivers license restored after 30 days.

Giving them no evidence got me the lowest fine, shortest probation, and fewest hours of community service of any DUI sentence issued that day.

I think it also helped that I showed up to court in my best suit and called the judge Sir, as opposed to wearing baggy jeans, a sideways ball cap, and being a disrespectful tard to the judge, like most of the other morons that were there.
