Im basically asking you think makes a child. We seem to throw common sense aside in America to protect the "children". Look Im all for hanging those who rape 6 year olds but someone is sexually mature is not a child.
What makes a child is irrelevant and being sexually mature does not magically turn you into an ADULT. What makes an adult is the full maturity of the brain which for a fact does not occur until around the age of 18! Up until that point especially for females, we need to protect their innocence until they are ready to take full responsiblity for their actions.
I see girls 20 and 21 who dont have a fully mature brain. Are they children to? Should I be sent to jail for life for having sex with them?
Interesting quesion, if they are clinicaly diagnosed as having a mental age of a child then yes and they would need to be treated like a child. Its probably a grey area of the law. |

I don't think it is purely a thought crime if he is actually soliciting sex. If he was sitting around thinking about it and not involving another person, then it's unpunishable. Soliciting becomes more than a thought. Human contact is made and thus an action is taking place. No longer an independant thought.

Debateable. In this case though, I have to concede that there was in fact a victim. He was in fact talking to a teenager on the other end of that internet chat. And if he knew it, then yes, I agree that it is a crime, and he should be punished. I would think that 5 years of probation and being added to the sex offender registry would sufficiently destroy the life of a teacher, and leave him in a position to be monitored regularly.

Ignoring the fact that the 14 year old almost certainly had zero or very little income. I thought judges in child support cases were supposed to take into account the financial circumstacnes of the father. I agree that the rules are unfair though.

To be perfectly honest, I am against the death penalty for the simple reason that we can never be certain of guilt. There are too many people set free by the Innocence Project every month, to give me any faith in the justice system to carry out capital justice. Now keep in mind that I have no problem with a genuine scumbag dieing a slow and horrible death, I just don't trust the system to make that choice. The same as if I were on a jury of a man who killed another man who he caught raping his daughter, I would not convict on a murder charge.
And you bring up a good point about talking about sex on the internet. You may be in a chatroom where someone says that they are 15 or whatever, yet it is completely possible to forget that fact in a sexually charged conversation that others may be involved in as well. I have been in porn forums on adult sites where kids would admit that they were there and were underage. So how would that work? Everyone in the porn room has to stop talking because some kid logged in with Daddy's account?
And then of course there is the entrapment issue. Where there isn't even a kid even involved. But some agent posing as a teen. Talk about thought crimes there.
