Pinellas Park, Florida-- A six year old girl sent to live with her grandparents as a baby is now being evicted from her home, for being too young.

The grandparents, Jimmy and Judie Stottler, live in a Pinellas Park retirement community that doesn't allow children. The Home Owners Association now wants the child removed.

"For some reason, there's a few, just a few who don't want Kimberly. And I just don't get it," said Judie Stottler.

The granddaughter was taken from her home at just six months old after the state discovered her mother was abusing drugs. She's lived with her grandparents against the rules ever since.

The family says they want to move out of the neighborhood, but by the time they put their home up for sale, the housing market crashed.

"They have no more assets to go out and purchase a rental property," said attorney Robert Eckard who is representing the family free of charge. "If they sell the home they can move. If not, they're homeless on the street."

The H-O-A president has been quoted saying he is only trying to enforce the rules. And while some residents argue the rules need to be followed, others suggest a compromise.

Either way, it will be up to a judge to decide what happens to the six year old next.

If the grandparents are unable to sell their home, the granddaughter could be sent to foster care.

That's something the Stollers say they will never let happen.

"They will have to drag me out in handcuffs and tear her from my arms," promises Judie Stoller.

"I'm not putting her out on the streets."

Sad, but those are the rules you sign for your right to live in a retirement community.

It is specialized to cater to older citizens who do not want to have to deal with the problems that come with having younger people around.

Sadly, this little child and the granparents are put in the middle of a dilemma because of this...but if one gets to stay, then others will soon follow.

I certainly hope and pray they can sell their home and can find another good, safe and affordable place to stay.

People who move to these types of communites do so for a number of reasons. Sometimes one of the reasons is lower taxes because they are not supporting a school district. Or they just want to live near older people. If they make an exception for this family, no matter how deserving or needy they may be, they will have to do it for everyone. Some states however, have a law which requires a small percentage of housing in senior complexes be set aside for younger residents. It varies by state though.

Yeah, agreed that they should have enforced the rules from the get go. Maybe the association assumed the child living there was temporary, who knows. Maybe there is a new association president who doesn't like them. Either way, they do have a contract.

A contract over the life of a little girl. That is roboticly sheeple brainwashed nazism. Contracts are agreements but in cercumstances such as these one would expect peole to have a soul and be able to solve the issues for everyone. It would not be too difficult if to solve if all these wingers got together and helped this family move or find a resonable solution.

I am amazed at how I am still shocked at how cold and bloodless many people on this planet are.

I wish the family and the little girl a warm hearted happy life.

I'll never understand people that don't want children or animals around. Such a sad way of living.

If it was the other way around, and no one over a certain age was around, it would be called discriminatory. But children can't fight for their rights.

I don't even understand how a community can discriminate against people based on age. If they did it based on race, people would raise hell. What is the difference? These crotchety old bastards down here can be a real pain in the ass.

Especially with no other kids to play with.

However, the parents bought the home before Florida home prices went crazy. I mean, they owned it at least going on six years. They may also have put a nice down on it instead of playing creative finance games because of their age and the fact that they probably had money from the sell of another house. Anyway, so they may very well have a bit of equity, and as much as said they would be willing to sell for below market. The association says no. So, no you cannot do the only thing you really could do in this market, and no you cannot stay. They can't have it both ways.

Theoretically, it would set a precedent where all the residents would be able to do the same. It's a shitty situation. similar to the flag issue a few weeks back, only this time it's a child involved, not a flag. I understand the community's perspective, but hope they come to some sort of resolution that isn't heartless.

it's probably a problem now because the child will have to attend school and that community probably doesn't pay school taxes. maybe they can compromise and homeschool the child themselves and just send in reports to the school district. it's one possible solution until they sell their home. that's why i don't want to buy into a 55+ community when i get older in case i have grandkids in my home.

They have a solid case. Retirement homes recieve funding from the federal gov in the form of medicare and medicaide. And The Age Discrimination Act of 1975 prohibits discrimination based on age in programs or activities that receive federal financial assistance.

Bullshit! When you agree to live in certain places that have rules, you agree to abide by those rules. A LOT of older people are sick of paying high taxes for services they don't use. There's a retirement community near where I live, which only has one small school. The retirement community pays taxes and does not burden the school district. No one's complaining because they signed on for this. It works both ways.
