Sen. John Ensign (R-Nev.) received a handwritten note Thursday from Joint Committee on Taxation Chief of Staff Tom Barthold confirming the penalty for failing to pay the up to $1,900 fee for not buying health insurance.
Violators could be charged with a misdemeanor and could face up to a year in jail or a $25,000 penalty, Barthold wrote on JCT letterhead. He signed it "Sincerely, Thomas A. Barthold."
The note was a follow-up to Ensign's questioning at the markup.

The debate over whether the federal government should require all Americans to carry health insurance is heating up.
The latest spark is a letter that Thomas Barthold, the chief of staff to the nonpartisan Joint Committee on Taxation, sent Thursday to Sen. John Ensign, R-Nev.
Given that the health-care bill written by Finance Committee Chairman Max Baucus contains a $1,900 fee (or excise tax) for not buying health insurance, Ensign wanted to know what would happen if an American didn't pay the penalty.
In a handwritten letter, Barthold told Ensign that under an existing provision of the Internal Revenue Code, willful failure to pay a fine can result in being charged with a misdemeanor which could carry a penalty of up to $25,000, or up to a year in jail, or both. The handwritten letter was a follow-up to an answer that Barthold gave Ensign during Thursday's mark-up of the Baucus bill.
Barthold felt that he was not as thorough during the hearing as he could be after considering the Internal Revenue Code.
During last year's campaign, then-Sen. Barack Obama, D-Ill., opposed an individual mandate. In fact, he clashed repeatedly with Sen. Hillary Clinton, D-N.Y., his future Secretary of State, on this issue.
Since becoming president, however, he has switched his stance and now shares Clinton's view that an individual mandate is necessary in order to achieve new federal protections for individuals with pre-existing conditions.
Pointing to experience at the state level, the insurance industry and other health-care experts persuaded Obama that insurers could not go along with a guanteed issue policy without knowing that all adults would be forced into the system.
Insurers say that if you have guaranteed issue -- which means no discrimination on the basis of pre-existing conditions -- without an individual mandate, people will wait until they become sick to buy insurance and the system will fail due to a lack of risk sharing.
Advocates of an individual mandate say that a requirement to buy insurance is essential because everyone is currently paying a "hidden tax" when people show up in the emergency room without insurance. (Under existing law, emergency rooms are required to treat urgent care matters without regard to ability to pay. If the patient cannot afford the bill, those costs are then passed to the government or people who have insurance in the form of higher prices).
When considering the possible jail penalty, it should be noted that President Obama envisions an individual mandate being structured with some sort of hardship exemption.
The Baucus health-care bill being considered by the Senate Finance Committee would exempt individuals who meet a government defined "unable to pay definition". There would also be an exemption for people whose religion conflicts with the mandate.
Despite the fact that there is broad support for an individual mandate among Democratic politicians, the insurance industry, many experts, and even a few Republicans, Barthold's letter potentially hands the GOP a big new weapon in the fight against Democratic efforts to overhaul the nation's health-care system.

Americans who fail to pay the penalty for not buying insurance would face legal action from the Internal Revenue Service, according to the Joint Committee on Taxation.
The remarks Thursday from the committee's chief of staff, Thomas Barthold, seems to further weaken President Barack Obama's contention last week that the individual mandate penalty, which could go as high as $1,900, is not a tax increase.
Under questioning from Sen. John Ensign (R-Nev.), Barthold said the IRS would "take you to court and undertake normal collection proceedings."
Ensign pursued the line of questioning because he said a lot of Americans don't believe the Constitution allows the government to mandate the purchase of insurance.
"We could be subjecting those very people who conscientiously, because they believe in the U.S. Constitution, we could be subjecting them to fines or the interpretation of a judge, all the way up to imprisonment," Ensign said. "That seems to me to be a problem."
Ensign's argument , however, wasn't persuasive to the committee -- which rejected an amendment from Sen. Jim Bunning (R-Ky.) to eliminate the individual mandate.
Sen. Olympia Snowe (R-Maine) was the only Republican to vote with Democrats to preserve the mandate. |

I am writing every congressman and senator (not just those in my state) and telling them how opposed I am to this monstrosity of a bill and to reiterate, they passed TARP without their constituents approval and if they go against us this time it will no doubt be to their dismay when election day comes. I plan on voting every one of them out and if the rest of the Americans had any balls they would register to vote and have 100 percent turn out. Do something! Imagine them being bombarded with 100 million emails, letters and faxes saying NO don't pass this. They really better think twice about this, people are getting fed up past their eyeballs. |

Let's say i'm a libertarian. And I'm voting for Ron Paul. And I don't want this total control of US government over my life. And then this bill passes, and I have to pay the gov 1900$ because they imposed this legislation on me. I chose not to pay it, because, paying a fine to NOT have a service is against the most basic logic plus all the ideology involved.
Then, I would be charged with a misdeamenor, now correct me if i'm wrong, but that would make me lose my gun-owning right if found guilty. Plus, they would charge me 25.000$ and/or send me to jail for 1 year... and of course, there's all the middle ground of taking your car, your house and your credit score if you don't pay the government.
So basically, refuse the government ``free health-care`` and YOU BECOME A CRIMINAL.
Obama, congress and the pharma lobby SURE ARE PRO-FREEDOM AREN'T THEY?
THIS IS OUTRAGEOUS and me thinks they try to arrest people over this, innocent people will die, feds and citizens.

I thought this was BS when I first saw it because ABC serves as a subdomain to go.com (I have no clue what that is). I checked though, and it's the official site.
This can lead to:
-Removal of children, weapons, and job if convicted.
-Removal of cars, homes, and other property if one fails to pay the fine.
-Forced vaccinations, dietary habits, et cetera.
