They get better treatment than 99% of any US citizen in any county jail in the country. Most are living better now at GITMO then they did in their homeland.

Military tribunals have defence lawyers and they last as long as it takes. Maybe he is going to civilian trial because there is doubt that he is an Al Qaeda operative? That is who the enemy is, isnt it? He will be charged, given a defence lawyer, and be most probably found guilty based on the evidence. What's the problem? The sentence? The civilian trial? A defence lawyer? The cost?

That wont stop them. Remember... a war is being fought. If all's you needed to do is kill them horribly when caught, then war wouldnt last very long, would it? Humans arent so easily intimidated, they tend to get more determined...

how so? You seem to be mixing official prisoners of war, and the fine line of a GI deciding to kill a defenceless enemy on the spot (usually out of rage, or an implicit understanding from COs to take no prisoners).
