48 Hours: Johnny Depp's Plea For Justice
Actor, Others Hope to Prove Innocence of West Memphis Three

Actor Johnny Depp and death row inmate Damien Echols talk with "48 Hours" about their fight for justice in the notorious 1993 murders of three boys in Arkansas. Hear more Saturday at 10 p.m.

In May 1993, the mutilated bodies of Chris Byers, left, Michael Moore, center, and Stevie Branch were found naked and drowned in a creek in Robin Hood Hills in West Memphis, Ark. (CBS)

(CBS) At 35, Damien Echols has spent his entire adult life on death row in an Arkansas prison alongside Jason Baldwin and Jessie Misskelley, who are both serving life sentences. The trio, all convicted of a triple murder, are known as the West Memphis Three, and they have gained widespread support from musicians including Dixie Chick Natalie Maines, Pearl Jam’s Eddie Vedder and actor Johnny Depp, who are determined to prove the men's innocence.

“They were easy targets… Every single piece of evidence points to their innocence, not to their guilt,” says Depp in an interview with "48 Hours Mystery" correspondent Erin Moriarty airing Saturday, Sept, 27 at 10 p.m. ET/PT. "People need to stand up and say, yeah, it’s time to find the real killers. Let’s find justice.”

In May 1993, the bodies of Stevie Branch, Chris Byers and Michael Moore were found naked and drowned in a creek in Robin Hood Hills in West Memphis, Ark. Amidst a countrywide media-fueled hysteria about cults, rumors swirled that the 8-year-olds were victims of a satanic ritual. Damien Echols, with his affinity for long hair and dressing in all black, became a prime suspect for police.

“I immediately related to Damien,” says Depp. “I come from a relatively small town in Kentucky…I can remember kind of being looked upon as a freak, if you will, different, because I didn’t dress like everybody else…I can empathize with being judged for how you look rather than being who you are.”

Appearances aside, police had no evidence linking Echols to the crime; that is, until 17-year-old Jessie Misskelley spoke to police. After hours of interrogation, Misskelley, whose lawyer says he has the mental capabilities of a 5-year-old and barely knew Echols, confessed to helping him and Jason Baldwin commit the murders. Yet many of the facts he recounted about the crime were wrong.

Nevertheless, the three teens were charged with murder. Jessie Misskelley was tried first and the defense attacked the investigation, including the fact that detectives lost evidence that may have led to another suspect. However, hi confession was enough and he was convicted and sentenced to life in prison. Three weeks later, Echols and Baldwin went on trial together. Misskelley refused to testify against them and by law his confession could not be used in this trial. Still, the teens were convicted. Baldwin was sentenced to life, Echols was sentenced to death.

Two years later as word of their case spread, so did the outrage over what many believed was a grave injustice. One of those who heard about the controversial case was Lorri Davis, a landscape architect from New York, who is now Damien Echols' wife of 10 years. “I just feel this momentum. There is a will to just right this wrong…to get them out,” she says.

Forensic scientists have challenged the causes of the wounds that were inflicted on the victims; sworn affidavits revealed possible jury misconduct and now, more than 16 years later -new DNA evidence points away from the three convicted men and to someone unexpected.

“The urgency of this is Damien Echols is on his last appeal and he is on death row,” says Depp. “The most courageous action that the state could now take is to admit that they made mistakes and correct these errors.”

In fact, as Damien Echols is prepared to take his case to federal court, he has some unexpected support from parents of the victims. Chris Byers’ father Mark and Stevie Branch’s mother Pam, who both cheered the guilty verdicts at the time, now agree that justice has not been served.

Sharp?

Maybe you're right about that. He's a pretty boy who got lucky and hasn't made a decent movie since Blow. He doesn't live or operate inside the Hollywood system until it's time to dance for the man and take his check from Irving and Finkelstein at Hollywood Inc.

And the best bit is that this 48hrs show 'coincidentally' happens to come around right at the very same time as Depp has left his French retreat to step out into the light to promote his latest celluloid abortion.

sharp? maybe. worth listening to? doubtful. Gen X, little boy lost, more money than sense, brooding, 45 year old who's been in the sun too long? definitely.

Leading Suspect (not convicted) taken from Wikipedia.

James Martin Sr., a new resident in the area and a known child molester, offered his testimony as an expert into the criminal mind. With the exception of John Mark Byers, he currently has the largest file (57 pages) at www.wm3.org and has often been thought to be the leading suspect, especially early on in the case. Why he was removed from the suspect list eludes many people. In addition to failing the polygraph test, he also described the crime in great detail, with much information that had not been released to the public at the time of his interview (including the fact that the boys had been tied with their own shoelaces). He presented obvious signs of Antisocial Personality Disorder, and had at one time been hospitalized and incarcerated for sexually assaulting both his stepson and stepdaughter. He currently lives in Gatlinburg, Tennessee.

Step Dad's profile from wikipedia [link to en.wikipedia.org]

John Mark Byers, the adoptive father of victim Christopher Byers, gave a knife to cameraman Doug Cooper,[28] who was working with documentary makers Joe Berlinger and Bruce Sinofsky while they were filming the first Paradise Lost feature. The knife was a small utility-type knife, manufactured by Kershaw.[28][29] According to the statements given by Berlinger and Sinofsky, Cooper informed them of his receipt of the knife on December 19, 1993. After the documentary crew returned to New York, Berlinger and Sinofsky reported to have discovered what appeared to be blood on the knife. HBO executives ordered them to return the knife to the West Memphis Police Department.[30][31] The knife was not received at the West Memphis Police Department until January 8, 1994.[32]

Byers initially claimed the knife had never been used. Blood was found on the knife, and Byers then stated that he had used it only once, to cut deer meat.[33] When told the blood matched both his and Chris' blood type, Byers said he had no idea how that blood might have gotten on the knife. During interrogation, West Memphis police suggested to Byers that he might have left the knife out accidentally, and Byers agreed with this.[3] Byers later stated that he may have cut his thumb. Further testing on the knife produced inconclusive results, due in part to the rather small amount of blood,[3] and due to the fact that both John Mark Byers and Chris Byers had the same HLA-DQα genotype.[34]

It is worth mentioning John Mark Byers agreed to, and subsequently passed, a polygraph test during the filming of “Paradise Lost 2: Revelations” in regards to the murders, but the documentary indicated that Byers was under the influence of several psychoactive prescription medications that could have affected the test results. Byers also volunteered his false teeth when presented with the challenge he had bit the boys bodies during the filming of the show, although at the time of the murders he had his original teeth, which he later had voluntarily extracted, and later claimed there was a medical reason for the procedure.

Byers has been persecuted by WM3 supporters for his behavior.[citation needed] The WM3 website (www.wm3.org) and the second documentary both seem to allude to the assertion that Byers is the murderer. Damien Echols was the first suspect to agree to a polygraph examination during the investigation. Even advocates for the use of polygraph evidence will generally volunteer the fact that polygraph evidence is not inherently admissible as evidence in any American court of criminal law, as such tests rely heavily on the opinions of the examiner administering the test, and polygraph examiners as a rule do not openly share their test data. This is part of why most criminal lawyers will not advise their clients to submit to a state-administered polygraph test, instead generally recommending independent commercial testing services by an examiner in good standing in the county of the court's jurisdiction.

In late 2007, John Mark Byers, adoptive father to Christopher Byers, announced that he now believes that Echols, Misskelley and Baldwin are innocent. "I believe I would be the last person on the face of the earth that people would expect or dream to see say free the West Memphis 3," said Byers. "From looking at the evidence and the facts that were presented to me, I have no doubt the West Memphis 3 are innocent." Byers is writing a book, and a film biography is being considered for production.[36] Mr. Byers has been speaking to the media on behalf of the convicted and has expressed his desire for "justice for six families."

I saw Paradise Lost back in the early 90s and I have followed the story ever since then. I do believe in their innocence, 1000%. I couldn't believe that was all taking place in this country, the whole legal process seemed so backwards and backwoods. I am pretty sure it was the pastor, he was so creepy. I think he's dead now, I know his wife is. I do hope these boys, well men now, can be freed before the freaking world ends already.

Re: A cause that maybe GLP can jump on - Johnny Depp's plea for 3 convicts to be freed
This was brought to my attention a couple of years ago. After looking through the evidence, it is pretty clear that these guys are innocent. There is only negligible and WEAK circumstantial evidence that wouldn't convict someone anywhere else in the country. If I had a media channel like JD to try to right an injustice, I'd do it too. Remember people, it is a jury of PEERS, lay people like you and me that ponder evidence and convict or acquit. Johnny Depp is just as qualified as you or me to review the evidence and make a decision. If it were anyone of you I'm sure you would be more than grateful that someone was willing to take on your cause that had access to media channels. Thank GOD that not everyone has lost their humanity.
