Ryan Michael Flores, 30, was caught on surveillance holding up a Starbucks in Fresno, California with a knife and gun back in July
His robbery was thwarted by 58-year-old customer Cregg Jerri who struck him with a chair and wrestled his knife away
Both Flores and Jerri suffered multiple stab wounds in the violent ordeal
Flores' family say he is now planning to sue the customer for excessive force
Police hailed Jerri as a hero at the time and say a potential lawsuit is 'ludicrous'
