Yes, to use the service you have to agree to the terms of service, including the recording of your voice for moderation purposes but I still wonder if that fully covers being recorded indefinitely in all future sessions on the device. For example, let's say that I have a PlayStation and I agreed to those terms of service on my account, but then my brother comes over later on and I let him play on the device with my account. He has not read the terms of service and has not been notified in any way about the potential for being recorded. In my state, both sides of the conversation have to consent to recording, otherwise it's illegal. I just wonder how that would shake out in a court case... At the very least I would think they would have to have a pop-up screen that asks the player to consent to be recorded every single time they launch a multiplayer game.
If i would be posting something wrong on Facebook they would have the right to shut my account down, which would lead to me not being able to use my Oculus Quest including the 100's of potential $ i might have spend on their games and apps (who werent even made by facebook) i too wonder about the legality in that. (not that im worried about it tbh) But its weird!
I received a threat of banning by Facebook just a couple weeks ago simply because I was in a "private" group discussing a video that was attacking me on YouTube. No one in our private group had any problem with my post, but Facebook's Orwellian censors took down the post automatically after a few minutes and I received a warning that if I posted anything like that again I would be banned from their platform. I didn't threaten anyone, I didn't even say anything foul, and I was not given any option to appeal the decision. The only thing I can figure is that their snooping is so invasive, their system went out to look at the YouTube video I linked to, didn't like what it saw being said on the video, and nearly banned me for posting it even though I was debunking the video. Facebook is a censorship nightmare, and there is no way I would ever pay hundreds of dollars for hardware that will be bricked (and any games bought for it on their platform would also be removed, without refunding) if I ever "say the wrong thing again" and they do ban my account. Some PlayStation 4 users who downloaded the latest 8.0 update got an unwelcome surprise this morning: their console informed them that Sony had the right to record their voice for moderation purposes.
Here is Sony’s exact language:
Following this update, users are seeing a notification about Party Safety and that voice chats in parties may be recorded. Voice chat recording for moderation is a feature that will be available on PS5 when it launches, and will enable users to record their voice chats on PS5 and submit them for moderation review. The pop up you’re seeing on PS4 right now is to let you know that when you participate in a chat with a PS5 user (post-launch), they may submit those recordings from their PS5 console to SIE.
To translate that statement, it seems that by joining a voice chat, even with the older PlayStation 4, your voice can be recorded and submitted to Sony for moderation by another user. This could certainly be invasive — in theory, anything you say in a voice chat could be sent to Sony without your explicit consent. But the feature could also be a useful tool to help people report bad party members that may be harassing them.
