U.S. asks court to reverse order lifting airplane mask...

Those flying in or out of the United States may soon have to put their masks back on, after the Department of Justice filed an appeal of an April decision that ended the unpopular mask mandate on planes and public transit.

The Centers for Disease Control had first implemented the mandate in February 2021 amid rising COVID cases, but as the number of cases started to drastically decline the mandate became unpopular among both passengers and crew members.

In fact, during a Senate hearing about the financial support airlines received in 2020 and 2021, American Airlines CEO Doug Parker and Southwest CEO Gary Kelly spoke out against the mandate.

'I think the case is very strong that masks don't add very much, if anything, in the air cabin environment,' Kelly said at the hearing in December. 'It is very safe and very high quality compared to any other indoor setting.'

Both he and Parker pointed out that airlines improved airflow on board their planes in the wake of the pandemic, noting that high-grade HEPA air filters on planes capture almost all airborne contamination and the cabin air is often exchanged with fresh air from outside.

'I concur,' said Parker, according to CNN. 'An aircraft is the safest place you can be.

'It's true of all of our aircrafts - they all have the same HEPA filters and airflow.'

Federal Judge Kathryn Kimball Mizelle finally struck down the pandemic-era mandate on April 18, ruling that the Centers for Disease Control and Prevention failed to justify why such a mandate was necessary as COVID cases were declining - and did not follow proper rulemaking.

She said that the CDC had exceeded its authority with the mandate, had not sought public comment about it and did not adequately explain its decisions.

But , Reuters reports, the Department of Justice filed an appeal of the decision on Tuesday, writing that 'None of the district court's quarrels with the CDC order comes close to showing that the CDC has acted outside the "zone of reasonableness."'

It added in the appeal that the CDC's findings on the spread of coronavirus in early 2021 provided 'ample support for the agency's determination that there was good cause to make the order effective without delay.'

It remains unclear, though, whether the CDC would reinstate the mandate even if Mizelle's decision is overturned.
