Saddam may face execution before standing trial on all charges

BAGHDAD, Iraq - Saddam Hussein could be executed before the Iraqi Special Tribunal finishes charging him with all his alleged crimes, a source close to the tribunal said Sunday.


For members of some groups allegedly abused by Saddam, the possibility that he´d not face their allegations drew mixed feelings.


His first trial, along with seven co-defendants, is set to begin Oct. 19. It will weigh charges that they massacred 143 people in Dujail, a predominantly Shiite town north of Baghdad, in 1982 after a failed assassination attempt. If convicted, Saddam could be sentenced to death.


On Sunday, officials began releasing more details of how the court will operate. Instead of a jury, a five-judge panel will hear the case and one will be the presiding judge. The defendants will be charged together, unlike in U.S. courts.


Each defendant will have his own attorney, an official close to the tribunal explained, and the judges may reach a different verdict for each. The official asked not to be identified because he is not authorized to speak publicly for the tribunal.


Once the court is finished with the first case, Saddam will likely face another trial for allegedly committing similar crimes in other communities, mostly Shiite Muslim and Kurdish areas, the official said. Saddam is a Sunni Muslim, the minority sect predominant in Iraq during his dictatorship.


If he is sentenced to death in the Dujail case, he will also begin his appeals process, the official said. Should he lose his appeal, he´d be executed 30 days later.


That could occur, the official continued, "before all the cases have been decided."


On the first day of the trial, the court will likely inform the defense council on how the court will work, read the charges to the defendants, hear from the defendants and address other court matters, according to the official.


But "I don´t think you are going to see them enter a plea," the official said.


The official could not say how long the trial might last.


So far, the Iraqi public has heard little about the case other than pleas by Saddam´s lawyer for more time. In an interview last month with Knight Ridder, Saddam´s lawyer, Khalil al-Dulaimi, said the proceedings would be "a political trial and not a legal trial."


Reactions were mixed among Kurdish and Shiite National Assembly members Sunday to the possibility that Saddam might be executed for just one of what they say were hundreds of brutal acts.

"We want Saddam to be tried for each case. However, we want the procedures to be quick," said Baha Araji, a Shiite assemblyman said. "We want them to carry out the capital punishment as soon as possible."


But Kurdish member Abdul Khaliq Zangana disagreed, saying: "We want him to be tried for all these crimes and not only for Dujail. We do not want him to be tried for one and let off for others.


The court rules are based on a statute written while the U.S.-led Coalition Provisional Authority led the country. Officials handed the procedures to an Iraqi-led government in June 2004.newsflashnewsflash

Three weeks after Germans voted in a deeply indecisive national election, the battered leaders yesterday emerged from lengthy secret negotiations and stitched together a government in which conservative Angela Merkel, the country´s first female chancellor, will lead a cabinet comprised mostly of ministers from her left-wing opposition.

Chancellor Gerhard Schroeder yesterday announced his resignation, after seven years of governing Germany in a coalition with the Green Party amid a growing economic and fiscal crisis.

In exchange for his agreement to cede power, he left behind a highly unusual "grand coalition" in which his Social Democrats will hold eight top cabinet positions, including Finance and Foreign Affairs, under the leadership of rival Ms. Merkel and her Christian Democrats, who will hold seven, including Economy and Defence. Neither party attracted much more than a third of the votes in the Sept. 18 election.

Ms. Merkel, who is both the first woman and the first citizen of the former East Germany to lead the country in its modern history, allowed herself the slightest smile as she announced the coalition yesterday.

She said that she felt "very good," and optimistically described the arrangement as "a coalition of possibilities."

But it could equally turn out to be a recipe for political deadlock. Members of the Social Democrats hinted yesterday that they were furious that Mr. Schroeder had allowed their party to form a government led by Ms. Merkel, whom they often liken to Britain´s Margaret Thatcher for her economically conservative views. They suggested that they may block the arrangement with votes in the legislature.

But the parties are not terribly far apart in their views on economic reform, and many observers speculated that such a coalition might make possible the sort of reforms to social programs and taxes that would otherwise have been blocked in partisan bickering.

Indeed, markets responded positively to the announcement yesterday, with most major German shares rising on the news and the euro rising against the U.S. dollar.

During his seven years in government, Mr. Schroeder had launched controversial cuts to the German unemployment-insurance system, which was designed for the full employment of the 1970s boom but proved unaffordable under the high unemployment levels that came after the fall of the Berlin Wall.

Ms. Merkel has pledged even more dramatic changes, though it is unclear just how different her reforms would be from those of Mr. Schroeder, who had already initiated cuts to corporate taxes. She pledged yesterday that she would make it easier for German companies to hire and fire workers, a controversial change that many consider vital to ending the unemployment crisis, but which Mr. Schroeder had not been able or willing to implement.

"Both parties are showing that they take the wish of the electorate seriously, which is to create better conditions for the people of Germany," Ms. Merkel said yesterday. "There is no alternative to a reform course in Germany, this is clear to both of us."

Key to her plans will be her choice for Economics Minister, Edmund Stoiber, the Christian Democrat governor of Bavaria, the most economically successful of Germany´s 16 provinces.

"There has to be work with the unions [to create labour flexibility], reform of the tax structure, income tax, employment conditions related to holidays, parental benefits, family benefits, mothers with children -- all of this is up for negotiation," she continued.

Another key difference between the two parties is their stand on the United States. Mr. Schroeder had played heavily on German anti-American sentiments about the Iraq war, which Germany opposed, while Ms. Merkel had boasted of her cordial relationship with U.S. President George W. Bush and pledged closer ties.

But Social Democrats were already hinting yesterday that they would moderate or block her most conservative option.

Its veryu interesting in respect of the cold as you have said it and so has main stream news. we will have to start preparing, we have already started stocking up.

May I ask about my home - west Michigan, specifically, Grand Rapids/Grand Haven? I saw earlier that you said the Great Lakes would be small. How come? It would seem as though with all the ice melting, it would be the reverse. There´s one scenario I can think of, for the water to drain, but I don´t know if it´s really possible, so I´ll wait for your opinion.

G´day Gaia Man, first of all I´d like to thank you on behalf of everyone here, including the naysayers, for your shared wisdom and intuition.

My question to you is regarding Vietnam and what will become of my beloved country. My country has been torn apart by politics and foreign influences ever since its birth and we have hardly seen any form of true peace and tranquility.
