"The laws allowing for the arrest of someone for an unpaid debt are not new. What is new is the rise of well-funded, aggressive and centralized collection firms, in many cases run by attorneys, that buy up unpaid debt and use the courts to collect." The report cited three Minnesota companies that have been driving the new debtors prison schemes: Unifund CCR Partners, Portfolio Recovery Associates Inc. and Debt Equities LLC. Portfolio Recovery Associates, based in Norfolk, Va., is a publicly traded company, which earned $44 million in profits in 2009, on $281 million in revenue—i.e., collections. I asked why I was under arrest and they did not have an answer at first. After I was in the police car and on my way to jail I continued to ask and they said they didn't know but all they knew was they had a warrant!! I did not find out the reason until after the entire intake process!! The debt was a hospital bill and the offense was not bond-able!! I had to pay the debt in full to get out!!!!!!!! This is complete bull shit and I hired a lawyer who told me that unfortunately they did everything within the law. They claimed that I was not arrested directly for the debt but failure to comply with the judgement. So if you have a judgement and don't pay it, you could go to the big house. |

If you miss a court date..whether it's with a collection agency or not, the judge can issue a warrant for your arrest. Also, if you're ordered to make a payment by a judge, and you don't, you can also be given a warrant for your arrest for violating a court order. However, you don't just go to jail because a collection agency says you owe money with no court order.....so quit fear mongering, this has ALWAYS been the law, it's nothing new. |
