Because they made up that rule, "Ignorance of the law is no excuse". It doesn't appear to matter that no person could EVER even read all the laws they make, let alone understand them all. Even lawyers have to specialise, not even a lawyer can know and understand all the laws they make.

This site charges for their ebook of information, but this is the gist of their arguments about fines.

About Traffic Fines

All traffic fines that are being currently issued in Australia are being issued unlawfully!

In essence, no "Road Rules" publiction in ANY state has been lawfully enacted. No state government can lawfully enact them because they contravene our funadental Constitutional rights (Section 92 of the Commonwealth Constituion) to travel freely on our roads.

All the road rules are just that - rules. They are NOT Acts or Laws. You must remember that these rules were only ever put in place to help create an even flow of traffic. It makes sense to have Stop signs and Give Way signs that INDICATE what people SHOULD do, but you cannot punish them for not doing it unless they actually cause an accident.

simply put....if an unlicenced driver has the most unfortunate mishap to have an accident....if there is no Motor Accident Insurance, and there is a death...these are unthinkable consequences...the Rule of Law is there...to nullify and mitigate the egresses of the most recalcitrant recidivist.

You had license plates on your car, which must have been stolen, so this shows you'll jump through that hoop and abide by that statute but not the driver's license statute? And as the driver of a motor vehicle, you refused to identify yourself (no name, DoB, address) and you were just given a traffic citation? Either there is more to this story such as a trip to jail pending your identification or you are full of bsflag.

Argue with them. Personally, I am not interested in researching the difference between Laws, Acts, Rules, etc, except for where they apply to my own problems.

I am merely trying to point people to information which can help people's in the same position as Shane, and for the people arguing about his right to argue and stand up to these so calls "laws".

What I do know, is that it is all an Act. That the people who impose and enforce these laws upon us, do not follow them themselves. And that is what pisses me off.

I have not had a drivers licence for about 3 years..

I have been pulled over for a breath test only once in that time.

They checked the car registration, which was politically correct, but they never asked for my drivers licence.

But now.. I get pulled over for not having a licence plate on my car.

My Dad says that someone must have pinched it because the screws are still there.

T.P.T.B are now ready to 'go' me.

1) I have a common law right to travel.

2) I have a constitutional tright to travel.
(section 92 of the the Aust. Constitution)

3) I have no contract with the State Government.

I will not hire a lawyer.

The 'bar' is a monopoly organisation.

This will be fun.

I do not have a drivers license. My spouse does. We both like to go out to the bars and drink the same amount. Yes, we both get drunk. We also have a cop friend who likes to drink with us. He says it would be best for me to drive(the one without the license) for a lesser fine/"punishment" if ever caught. So thats what I do I drive drunk!

There is a few groups in Australia who do drive without licences or without registering their cars, because they had a barrister on their side who was able to prove their cases in a way the court approved of.

If it can save you a fine, it is worth arguing. If you don't believe in being controlled, then as Martin Luther King says, if you don't take a stand for what you believe in, then you might as well be dead.

Me, I would try to avoid court, since only the lawyers win there, with their pockets. If I am ever unfortunate enough to have to enter a court, and I do have an outstanding fine at the moment, I will do the same as Shane, represent myself and refuse to feed the trolls of the world.

If the law in Australia is anything like the laws are here, you can drive/ operate/ make go fast -- any sort of contraption in your own back yard, or upon the property of anyone else who gives you permission to do so.

You can sit your kid up on phone books in the seat and let him drive around your own back yard.

That's how I actually learned to drive.

The matter at issue is "upon whose property" one operates machinery.

I was a trial lawyer for years until I just got fed-up and quit. Now I daytrade and life is SO much nicer . . .

But what so many well-meaning people just don't understand is this: the Court system is completely corrupt. Outsiders have ZERO chance of winning. Some Judges in State Courts are still honest but every single Federal Court Judge is bought-and-paid for -- or else they would never get the lifetime appointment necessary to be a Federal Judge. 95%+ of all State Court Judges too.

Judges are politicians that wear black robes and demand that you grovel and treat them as if they were superior when, in fact, most lawyers (that are even decent) make FAR more than a Judge. They have to take a big pay cut to be a Judge, so they're not interested. The Judge Politicians need that sweet job so they don't actually have to practice law -- which they suck at and can't do.

The Judge Politicans have to keep their Masters (higher-up politicians) happy or else it's back to their tiny little, sucky law office . . . and so a case is really decided before the first word is spoken in Court.

I wish to OP best of luck . . . but sadly you're gonna' lose!

Permission is not required.

The granting of license isn't for permission to travel. It's for permission to drive a car. When you drive a car, you are in control of a 2000 lb missile. Don't know what it's like in Australia, but in America you are tested to ensure you know the rules of the road.

I'm all about freedom too, but who wants some jackass on the road with me who can't friggin' drive?
