It is estimated that over 50 million Americans live in approximately 205,000 covenant-controlled communities, governed by a homeowner association.

These planned communities and homeowner associations have evolved from a utopian socialistic ideal to undemocratic, private governments that govern without a Bill of Rights and proper checks and balances.

More and more Americans are moving into these types of communities every year, But this is more a cause of the spreading of association-governed housing developments than an actual desire by Americans to live in this type of community.

One could argue that an HOA is a modern and legalized dictatorship.

My property (20 acres) borders up to a HOA gated community and I have lived there long before they built the community.
They seem to think my property falls under their jurisdiction.
I am constantly getting "notices" that my fencing is not to standard, that there is no child proof fence around my stock tank/pond etc...
I have already taken them to court over this and have a writ from the judge stating that my property does not fall under their jurisdiction.
I've just been saving the notices so I can haul them into court again for harassment.
BTW, you would have to trespass (I have signs up) to see my pond which sits in the middle of my property.

Learn the law, they are not unconstitutional. You are not forced to live in a HOA. They are completely voluntary. The constitution and SCOTUS both protect the right to freely enter into contract. If you do not like the rules you should not have moved there. I live in and own rental properties in a HOA. It is great, it keeps the property values up.
Now municipal codes I agree can cross into the realm of unconstitutional, however it depends on your state. People assume the federal constitution is what binds the GOVT in their lives. Not so, it is your state constitution that matters when determining the validity of an ordinance/code/statute/regulation/covenant

If the HOA was in effect when you purchased your house, then you are bound by it's rules because you were given notice before you closed on the purchase. You can volunteer and eventually take over it, because the fuddy duddies that run them have to have their afternoon naps and they tire easily.

If the HOA was put in place after you purchased your land then you are not required to obey it's rules. If you join it at a later date then you have bound your property from then on.

The questionable instance would be if your parents owned the property before the formation of an HOA and never vountarily joined but then died and you inherited it would you be subject to their rules? I wouldn't think so but that would be a gray area.

Here is how it works. They reserve the right to up your HOA fees anytime they want to. Then they sub-contract out the policing out to a private company of NAZI enforcers.

Then the people that always get elected to run the HOA give out lucrative contracts to their buddies to maintain the pool, tennis courts and common areas. Lots of under the table money being given back to the HOA heads.

Then they write up residents constantly for having weeds in their yards. This forces you to hire a weed company to spray your lawn with poisonous weed killers. When it rains these poisons drain down to the nearest creek polluting the creek.

Our HOA is so destructive that they won't allow you to have screens on the windows that face the front of the house. Says it is "eye pollution". When it gets hot in the summer then it means you can not open your front windows and get any circulation. This forces you to turn your air conditioner on full force. Using up electricity, big electrical bills. More pollution using up electricity unnecessarily.

Most of these HOA nazis are self described liberal and supposed to be green advocates but the truth is they are the biggest polluters alive.

If you don't agree to the rules, don't buy that property.

I've often thought to myself that I'd absolutely live in a HOA type home since they're some of the most beautifully, expansive houses I've seen physically and in other ways, but I don't want to live in such neighborhoods for the OP's reasons and I still want to retain my freedom and privacy allotted to me through living in the countryside. So I'd rather buy a few acres minimum in the countryside and build a HOA-like home or better on said property.

Not if you go by the founding father about one such group who are never to be allow to migrate to the USA. That was Muslims, because of the government religion, it not a religion is government control of people by religion, and they try to force it on people.
