Merck found liable in VIOXX Trial
This is major news being announced from Texas this afternoon. The jury deliberated for 10 hours to reach the decision that Merck is liable for the death of the man who died as a result of taking VIOXX. They found Merck guilty of negligence and malice. It has been mentioned repeatedly that this case was weak and not the strongest of the VIOXX cases. Many are speculating that the information that was allowed by the Coroner is what helped the jury decide the case.
Currently there are over four thousand cases awaiting trial against Merck in relation to VIOXX. In the coming days those case numbers could double! Legal analysts are predicting settlements from Merck on many of the pending cases.
The huge jury award to a plaintiff in the nationīs first Vioxx case is likely to inspire thousands more suits on top of the 4,200 already filed against the drugīs marker Merck Co. and push liability estimates that reach $18 billion even higher, analysts said. Merck Co.īs stock sank $2.35, or 7.7 percent, to close at $28.06. The jury awarded $253.4 million in damages to a widow of a man who died in 2001 of heart arrhythmia, or irregular heart beat, after taking Vioxx for around eight months. The company plans to appeal. Merck yanked the popular pain reliever from the market last September after a study found it doubled patientsī risks of heart attacks and strokes after 18 months. |

We here on GLP can know the drug companies can be a tad nefarious till the cows come home, but if the courts donīt believe it, nothing will ever come of it.
This Texas decision sets a good precedent. |

Vioxx was put back on the market. I feel like going into a Walgreens when itīs really busy, go up to the counter and say "Iīm here to pick up my Vioxx refill" and then throw a couple Alka-Seltzer in my mouth and start rolling around on the floor. See how many lawyers start throwing their business cards on my chest. |
