There is no Constitutional basis for a marriage license. It's not Biblical either and would be like baptism licenses. In American history, the standard rule was a minister of some kind or certain public officials like judges could marry people, and then in the former case, the couple would notify someone in town atsome point when they went in for supplies. That might bea couppe times a year.

It was weird when I was young for anyone to not get married in church. It was a red flag as the couple had eloped because neither her parents nor the pastor approved. Somethin' ain't right. So those were hasty marriages by justices of the peace and likely doomed.

Even a soldier would knock on a pastor's door with his sweetheart and he do a marriage ceremony if there was need, and maybe a public ceremony later to acknowledge the couple properly. Even if the couple was broke, the whole church would have pulled together with cooking, flowers, decorating. Anything less would have reflected poorly on the whole congregation.

Marriage should be reduced to a religious contract only without any secular laws around it.
