Child support laws are about 50 years behind on the times. They essentially put ALL the responcibilty on the man to provide for the family. This impoverishes the man and benefits the woman who ends up using most of the money to play with. It cause men to not want to marry, not want to have children.

We no longer live in a fully male dominated society so therefore the laws should reflect that.

If your splitting up custody 50/50 then you should pay for your children 50% of the time.

All he had to do was make some sort of payment. Even only 10.00 dollars a week would have been enough until he got on his feet. The courts couldn't have done diddly. Millions of fathers are in the same boat.

I thought the payment the father made was based on his income. They will take part of social security to pay child support. If he had no money, then can they really put him in jail?

Wake up, the courts can state whatever amount they want, they're suppose to use a formula but it can be changed by a judge at their discretion, kind of like a recommended prison sentence...

After reading the story, his last statement, and the comments on here; all I can say is the family unit has been totally disseminated. I am appalled at the hate that is coming out of this thread.

If the court finds beyond a reasonable doubt that the parent has willfully failed to pay pursuant to a valid child support order, the court can order the nonpaying parent jailed. (A parent who can show that they did not have the ability to pay will not be found in contempt of court, even though he or she will continue to owe the money.)

Really? I lost. I am a middle class mother with a Masters Degree in Marketing. My ex and I split and he took our kid to a small town he grew up in 100 miles from the major city I live in. I filed for custody here in the major city, but felt that it was my obligation to notify him that I had done so. He and his mother rushed to file their own custody case in the small town. The small town deputized his mother so she could drive 100miles back to me and personally "serve" me the papers. (all this time my major city was still processing my paperwork) Because my ex served me first, the court case had to be held in this small town. This small town doesnt like big city folk, and in the court hearing we both got joint cutody BUT********* he was awarded "custodial parent" (even though his income is barely over poverty level and he and his girlfriend are on wellfare) AND*******GUESS WHAT?? I was awarded to pay child support to him every month, with only visitation rights to my daughter.

This was 4 years ago. I have recently taken him back to court to get half the time with my daughter(because that is what joint custody is suppose to be about...not this stupid visitation crap of only once every other weekend) and so, it is more equal now-but I still pay him...AND he and his girlfriend now have two kids of their own, still on foodstamps and medicaid..living in a really bad part of the city, and my daughter suffers.

I have an older daughter who is starting middle school this year (not from this relationship) and I am putting her in a private school. I begged my ex to please let me put my other daughter in a private school too, because she currently attends a highly over-populated city district school that is in a bad area.
He told me no...and I can do nothing because he has been granted custodial parent.

So, as you can see....WOMEN DO NOT ALWAYS WIN. Even those of us who are educated and responsible.

He did get visitation regular with his son, and was petitioning for visitation of his two daughters.

When I was divorced, my ex and I agreed on a fair settlement. Later she changed her mind and drug me back to court to get more money. I went with a really good aggressive lawyer. The judge called the attorneys into his chambers before we went in. Ten minutes later he called for my ex. I was sure that was bad. After another ten minutes, she walked out crying, with the lawyers close behind. The judge ripped her and her attorney for bringing a frivolous suit with no basis for rewriting the agreement. The wife does not win every time. Sometimes justice prevails.
