Texas Gov. Rick Perry (R) has, to say the least, a very odd understanding of the Constitution. He thinks Texas should be able to opt out of Social Security, and he believes that everything from federal public school programs to clean air laws are unconstitutional. Yet in an interview with the Daily Beast’s Andrew Romano, Perry makes his most outlandish claim to date — Social Security and Medicare are unconstitutional:

The Constitution says that “the Congress shall have Power To lay and collect Taxes… to provide for the… general Welfare of the United States.” But I noticed that when you quoted this section on page 116, you left “general welfare” out and put an ellipsis in its place. Progressives would say that “general welfare” includes things like Social Security or Medicare—that it gives the government the flexibility to tackle more than just the basic responsibilities laid out explicitly in our founding document. What does “general welfare” mean to you?

They probably are. I'd rather not pay SS and manage my own retirement. (i.e. not pay for the other 50% of the population to sit around and be a bunch of entitled useless eaters)

Here is a road map for my Governor
to get the US out of Social Security.


Phase out Social Security with refunds.

Most baby boomers will still be on the SS system...
refunding all of them would break the bank.



Phase out SS in tiers.


People retired or close to retirement [age 55+] would be
on the current SS system, no refunds.

People in the next 10 year tier [ages 45-54] get a choice
between a refund with fixed rate of interest or current SS.

The next tiers [age 44 and below] should get refunds with
a sliding down interest rate.

When originally proposed, the Social Security program was unconstitutional as the constitution did not authorize congress to require citizens to pay into a retirement system that they might never be able to collect on. The supreme court of the day warned FDR that they would rule against him on constitutional grounds. FDR however fought back by warning the supreme court that he could simply appoint more judges until he got the number he needed to rule in his favor. The Supreme realized that a move like that would render the whole judicial branch irrelevant, and FDR being a very popular president at the time, the Supreme court caved.

The founding fathers never intended for a powerful central government to have the authority to take people's money and hold it for a retirement they might never see. If you don't live long enough, you will not only never see your money returned, your family will never see your money because once the federal government steals it out of your paycheck it is gone. Your money has been stolen. There is no account with your funds to draw from. It is government mandated theft and it is unconstitutional.

It is mentioned in The Law of Nations by Vattel four times. This was one of the primary documents used to frame the Constitution. In all four of those references, never does it imply provide materials or funding directly to individuals. Instead, general welfare is used in the context of unity.

Those useless eaters worked for 40 years or more and paid into Social Security. It's NOT the government's money, it's the workers money. Social Security is not an entitlement program. It's paid for by workers out of their paychecks.

Come back and tell me when your in your late 60s or early 70s how tired you are from working all your life and how you would like to "sit around and be ... a useless eater."
