DNA test confirmed, automatic 20 grand back child support. 2 months later warrant issued for arrest for back child support because it was more then 5k in past due. Didnt matter that I was just ordered to pay it. The only Debtors Prison System left in America. Took emergency funds from my 401k and paid 15,000 lump sum to get courts off my back. |

First off, child support can go until they are 24, if they are enrolled in college. After 18, the mother/guardian has the right to sue for back child support. It no longer goes to the child at that point. Because the motehr/guardian paid the "child's way", and now the money is owed to her. I almost had my mother sue my father for 18 years of child support and we talked about splitting it. We decided against it though. |

We went on our seperate ways. 12 years later, BAM child support case. I didnt even know I had a daughter?! Correction: OP --> 16 1/2? FAIL! I think the quotes got messed up. I was always broke during those early years and it was hard. BUT i made every payment for the children. The time will go by very fast, nothing remains static... better jobs will come your way, you will adjust and make lifestyle changes and soon enough it will be easy to afford. I hope you are planning on having a relationship with your daughter. I maintained my relationship with mine and we are very close to this day. My last child support payment was last December. It was like getting a big raise. Now i send money to my daughter for school... oh well, i'm just glad i have her. |

Xiao en (OP) User ID: 3899217 United States 11/10/2011 05:40 PM Report Abusive Post Report Copyright Violation | Beacause there were multiple opportunities for the mother to have the child tested and she didnt, the law of latches was ruled in this case, meaning the mother could not collect back child support, however the court stepped around this ruling by saying this amount is owed to my daughter. this payment is split in 2 one payment from birth to 16.5 to my daughter, from the time of the courts action to 18 this payment goes to her mother. How can one child support court make a ruling over top of another counties child support ruling that has already been in court?? In my mind they should only be able to take action from the time they initiate their preceedings. Now they were periodocialy on welfare, and because the state was unable to say how much was given directly to my daughter the whole case has been assigned to me, 6 people, the step dad, mother and 3 step brothers and sisters. More than half of these arrears are owed to the state welfare system. Because I owe more than 5,000 in arrears I no longer have a passport or drivers liscense. Nevermind the fact these arrears were all assigned in 1 day. Im not a criminal. I obey the laws, would like to think am a decent person. Now I am a paranoid individual which is more than careful and always looking over my shoulder with a yellow streak down my back and breaking into a cold sweat everytime i see a law enforcement officer. There are so many things about this case that are wrong on so many levels, Tomorrow I am calling for an appointment with the attorney generals office as I can get nothing resolved thru the county child support office. |
