How Counties Can Use Land Banks and Eminent Domain
Relief for Counties: Land Banks and Eminent Domain

The legal tide is turning against MERS and the banks, giving rise to some interesting possibilities for relief at the county level. Local governments have the power of eminent domain: they can seize real or personal property if (a) they can show that doing so is in the public interest, and (b) the owner is compensated at fair market value.

The public interest part is easy to show. In a 20-page booklet titled "Revitalizing Foreclosed Properties with Land Banks," the US Department of Housing and Urban Development (HUD) observes: [link to www.huduser.org]

political correctness is a doctrine.... fostered by a delusional, illogical minority...... and rabidly promoted by an unscrupulous mainstream media; which holds forth the proposition that it is entirely possible to pick up a turd by the clean end.

The State bought 1/2 acre from us last Fall for a highway right-of-way and had to pay us at market value. The last land we sold was for a truck stop, they paid us $43,000 an acre for 3 acres. That means to Eminent Domain our property they would have to come up with 21 and a half million bucks. Do not think they would want it that bad.
