Morris: Libby Indictment Implicates Cheney

On Fox News, former presidential advisor Dick Morris says today’s events don’t bode well for Dick Cheney:

JOHN GIBSON: How bad is this damage? And what does the president need to control it, Dick?

DICK MORRIS: Well, it depends on whether we are just talking about Libby. If the prosecutor is happy with an indictment of him, a conviction, and that scalp on the wall is sufficient for him, then it just goes away. It’s one bad chapter and it passes.

But it is very possible that the prosecutor looks up the food chain to Vice President Cheney. These investigations have a way of rising. And according to the terms of the indictment, Cheney told Libby about Valerie Plame and then Libby lied to the grand jury about how he found about it, saying that he got it from a reporter. Well, if that’s the case, the vice president knew that Libby was lying.

And it wasn’t like his grand jury was secret. It was all over the place, you could read it in any newspaper. So my question is, why didn’t the vice president say anything? Why didn’t he speak up? And when you’re out there committing perjury and your boss is silent, and your boss knows that you’re doing that, it’s [the silence is] a subtle signal from your boss to say, “I appreciate it.”

First off no one asked Cheney if he he was the one who told Libby. Cheney was never called into the grand jury to testify. So Cheney knowing Libby was lying does not enter the picture legally yet. Also Fitzgerald said a few times that there is nothing illegal about Cheney or any Government offical with the proper security clearence to talk to each other about Plame.
Cheney, however is the prosecution´s lynch pin. They will need Cheney to testify at the trial that he told Libby about Plame to line it all up with Libby´s notes.

She hadn’t been a covert agent for six years, and everyone in Washington knew she worked for the CIA.

Special Prosecutor Patrick Fitzgerald knocked that talking point down hard today in the Libby indictment:

At all relevant times from January 1, 2002 through July 2003, Valerie Wilson was employed by the CIA, and her employment status was classified. Prior to July 14, 2003, Valerie Wilson’s affiliation with the CIA was not common knowledge outside the intelligence community.

Addington Involved In Leak Scandal

Scooter Libby’s replacement as chief of staff to the Vice President is reportedly a man named David Addington. He was formerly Cheney’s counsel, a position he held since 2001. According to the indictment, it appears that Addington was involved in the leak:

18. Also on or about July 8, 2003, LIBBY met with the Counsel to the Vice President in an anteroom outside the Vice President’s Office. During their brief conversation, LIBBY asked the Counsel to the Vice President, in sum and substance, what paperwork there would be at the CIA if an employee’s spouse undertook an overseas trip.

Was Addington aware that he was facilitating alleged criminal conduct?

CBS News legal analyst Andrew Cohen reports the indictment "makes it very likely, almost a certainty" that Cheney will have to testify in the criminal trial against Libby.

If so, Cheney, who prizes secrecy, will be called upon as a witness to explain why the administration launched a campaign against Plame´s husband, diplomat Joseph Wilson, a critic of the war who questioned Mr. Bush´s assertion that Iraq had sought nuclear material.

That´s not the point. It´s NOT perfectly legal for Cheney to order his chief-of-staff to reveal classified information to a reporter. THAT´s what Fitzgerald will be focussing on in the next stage of his investigation. Perhaps he already has, if the reports of three sealed indictments are true.

Fitzgerald is one smart guy. He can now push Libby hard to roll over siting 30 years in prison as motivation. If Libby turns than Cheney is mince meat. If they go to court then Fitzie can get Cheney on the stand, and once again he is done. The only way Cheney can avoid all this is to make sure there is no trial. Libby is starting to look a little depressed, suicide anyone?

Why was any of this an issue at all?

Because the Bu(ll)sh(it) bozo bunch went to war to get oil (or possibly because they were looking for some old power sources they hoped or thought might be in Iraq that could maybe help save their asses from the GF) by manufacturing justification out of thin air.

The Plame/Wilson affair was to send a signal to anyone who crossed purposes with the bozo bunch that they would get hurt.

I hope that Fitzgerald meant what he said about sending a signal to the world that the United States is very serious about prosecuting those who break the law, because so far, we are talking about putting a bandaid on a small cut while the patient is bleeding to death from a lacerated juglar.

Well, Dicky, so are all those you are still illegally transporting, imprisoning, torturing, and murdering in Gitmo, Abu Ghraib, and other sectert little slaughterhouses the American taxpayers are funding all over the world. Joe Wilson, whose wife’s unmasking as a CIA agent is at the center of the special prosecutor Patrick Fitzgerald’s investigation, said today that that his wife, Valerie Plame, has been threatened. Wilson talks to 60 Minutes correspondent Ed Bradley, in his first interview since Fitzgerald announced the indictment of I. Lewis Libby, Sunday, Oct. 30, at 7 p.m. ET/PT.

"There have been specific threats (against Plame). Beyond that I just can’t go," Wilson tells Bradley. Wilson says he and his wife have discussed security for her with "several agencies." Former CIA colleagues say that by revealing her identity, harm could be caused to the CIA’s agents and operations. "If a CIA agent is exposed, then everyone coming in contact with that agent is exposed," says Jim Marcinkowski, a former CIA agent who trained with Plame at the top-secret Virginia facility known as "the Farm." "There is a possibility that there were other agents that would use that same kind of a cover. So they may have been using Brewster Jennings just like her," said Marcinkowski, referring to the fictional firm the CIA set up as her cover that also came out when journalists, including Robert Novak, disclosed it.

Marcinkowski also points out, "(Plame) is the wife of an ambassador, for example. Now, since this happened…they’ll know there’s a possibility that the wife of a U.S. ambassador is a CIA agent." Another friend, once a covert CIA operative, says people who say Plame wasn’t in a sensitive position need to understand how intricate a cover story is, regardless of what an agent is working on. "Cover is…for a clandestine officer, can be different things at different times. We change cover. We modify cover based on how we need it. But that cover is linked together," she tells Bradley. "If you start to unravel one part of that, you can unravel the whole thing."

Rep. Rush Holt, D-N.J., a former intelligence analyst and member of the House Intelligence Committee, agrees. "I think any time the identity of a covert agent is released, there is some damage -- and it’s serious." Holt says it’s possible agents overseas could be arrested or even killed, but "if there were, and I’d been briefed on it, I couldn’t talk about it," he tells Bradley. He did say he has been assured the CIA was mitigating the effects of the leak. "They have taken the usual procedures to protect the damage from spreading."
