Dog breeders who skirt animal welfare laws by selling puppies over the Internet would face tighter scrutiny under a rule change proposed Thursday by the U.S. Department of Agriculture.

The change would subject dog owners who breed more than four females and sell the puppies electronically, by mail or over the phone to the same oversight faced by wholesale dealers as part of the Animal Welfare Act.

Now the kicker, from the US Department of Agriculture site:


The proposal will restore the definition to its original intent so that it limits the retail pet store exemption to only business and residences:
• where buyers physically enter to observe the animals available for sale prior to purchasing them, and
where only the following animals are sold or offered for sale at retail for use as pets: Dogs, cats, rabbits, guinea pigs, hamsters, gerbils, rats, mice, gophers, chinchilla, domestic ferrets, domestic farm animals, birds, and coldblooded species.

What this means is that if you have 4 or breeding animals, be it dogs, cats, RATS, birds, horses, etc. and you have an internet website, or you sell through a classified ad and answer the telephone, you cannot sell to people "sight unseen" and ship whatever animal it is, even if they have seen pictures or video of the animal beforehand.

What is ironic is just by physically seeing the parents, you have NO IDEA if an animal is "genetically sound".

Federal Informational Update: USDA/APHIS Rule Impacting Small/Hobby Breeders Advances For Executive Review

The AKC has learned that United States Department of Agriculture (USDA)/Animal and Plant Health Inspection Service (APHIS) has completed a full review of all public comments on proposed changes to federal Animal Welfare Act (AWA) regulations affecting “Retail Pet Stores and Licensing Exemptions”. A final version of the rule has now advanced to the Office of Management and Budget (OMB) for further review and possible changes ahead of publication as a final rule by USDA. Typically, it takes 30-90 days for the OMB to review a final rule before it is returned to the USDA. Once a rule is published, there is generally a period of months before any changes to existing law are implemented.

Unfortunately this will not actually help ensure welfare of animals, but instead cause the US government to continue to grow and exert more power. The creators of the regulation were the HSUS and PETA, whose end-goal is to stop the breeding of ALL animals.

I realized that if they were jerks about it, I guess you could have 5 or 6 chickens and sell the eggs online or the peeps, sight unseen before purchase, you'll have to be inspected.

The Humane Society of the United States applauds this and also said there's a similar bill making its way through Congress right now:

Legislation currently being considered in Congress, the Puppy Uniform Protection and Safety (PUPS) Act, S. 707 and H.R. 835, would achieve a similar reform to the rule proposed today by USDA, and would require Internet puppy mill sellers to meet federal animal care standards. The HSUS and HSLF express their thanks to the bipartisan sponsors of the legislation, Sens. Dick Durbin, D-Ill., and David Vitter, R-La., and Reps. Jim Gerlach, R-Pa., Sam Farr, D-Calif., Bill Young, R-Fla., and Lois Capps, D-Calif., for advocating for this policy reform.

I have never bought anything online, but if people choose to do so, why not let them? This draconian law is nothing but a control issue. Big brother is here, and will continue to intrude more and more into every aspect of the sheeples lives.

It's no longer "Buyer Beware"....this is going to impact not just puppy mills, but anyone that is into breeding to benefit the breed, because a lot of people who show their dogs may have multiple dogs but not many litters. They will no longer be able to ship their dogs without being inspected. Breeds themselves will suffer as I'm sure a lot of breeders would not want the hassle and so lines will be bottlenecked into certain areas unless people are willing to drive to get the dog (IF those breeders are still breeding).

Are you a fool or what? State laws can even regulate the amount of dogs you own or are produced, BEFORE they are sold. It doesn't matter where they go if they are regulated before that point, and while they vary, most state laws already address this.

We do have too many animals, Government needs to step in for the few stupid people. In my town dogs became sport hunting for some freaks and they were dumping them in the river

We can do with one quarter of the animals we have today

I heard of kids picking up free kittens and puppies from the ads just to feed to their pet boa constrictor

If you think this is unfair, trust me, every Joe Blow and Shady immigrants will jump on the pet classified bandwagon and inbreed too many animals in dirty conditions to try and make the big bucks, esp with the toy and show dogs

If you want to buy a 400 dollar animal and find out its forged papers and has a genetic disease, than go ahead

People in the news have been ripped off from shady puppy mills. Its like you guys dont read the news.

Why can your state or municipality do something?? My state has laws, for PA if you own and produce 26 or more dogs in a year, you need to have a kennel license and be inspected. That would include puppies, and so depending on the ratio and litters, you could have say 4 dogs and then 3 litters of 7 and be right at the limit, MORE than that you'd need a license.
